ACCESS LICENSE AGREEMENT <br />City of Hugo, a Minnesota municipal corporation ("City"), owns park property located in <br />Washington County, Minnesota, as depicted on the attached Exhibit A (the "Property"). Rice <br />Creek Watershed District, is a public entity created under the laws of the State of Minnesota <br />("District"). <br />The Property abuts the channel of Anoka/Washington Judicial Ditch (AWJD) 3. The City <br />desires to grant the District a license to access AWJD 3 through the Property according to certain <br />terms detailed herein. <br />Access to AWJD 3 through the property shall be confined to the route depicted on <br />Exhibit A. This license is limited to ingress, egress and access for construction, operation, and <br />maintenance of AWJD 3 ("Repair Project"). The District shall execute its rights under this <br />license as limited herein. <br />1. The District will assure that use of the Property will be reasonably confined and <br />not unnecessarily interfere with the City's use of the remainder of the Property. <br />2. The District shall restore the Property, as nearly as is practical, to pre -use <br />condition, as established by a joint, pre -use inspection, and shall repair any and all damage to the <br />Property resulting from exercise of the rights granted herein. <br />3. The City shall limit use of the Property during the Repair Project so as not to <br />interfere with the Repair Project or expose the public to unnecessary risk during the Repair <br />Project. <br />4. This license shall terminate upon satisfactory completion of the Repair Project <br />and the expiration of any correction period specified in the construction contract, not to exceed <br />two years from the date of project completion. <br />[Signatures on the Following Page] <br />[ 16266-0040/3776849/1 ] <br />
