RESOLUTION 2022-6 <br />APPROVING A FINAL PLAT AND DEVLEOPMENT AGREEMENT FOR M/I HOMES <br />OF MINNEAPOLIS/ST. PAUL, LLC, FOR RICE LAKE RESERVE 2nd ADDITION <br />WHEREAS, M/I Homes of Minneapolis/St. Paul, LLC, has requested approval of a final plat for <br />the property legally described as follows: <br />See Attached <br />WHEREAS, the Planning Commission has reviewed the preliminary plat and PUD at a duly <br />called public hearing and recommended approval of the preliminary plat and PUD; and <br />WHEREAS, the City Council approved the preliminary plat and PUD at its meeting on January <br />6, 2020. <br />WHEREAS, the City Council approved the Final Plat for Rice Lake Reserve at its meeting on <br />November 16, 2020. <br />NOW, THEREFORE, BE IT HEREBY RESOVLED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by M/I Homes of <br />Minneapolis/St. Paul, LLC, for a final plat and development agreement for Rice Lake Reserve <br />2nd Addition, subject to the following conditions: <br />1. The final plat is approved to allow the creation of 31 single family lots and 2 outlots, in <br />accordance with the plans and application received by the City on December 22, 2021, <br />December 30, 2021, and January 26, 2022, except as amended by this resolution. <br />2. The development shall substantially comply with all plans and conditions of the PUD and <br />preliminary plat approval granted by the City on January 6, 2020. <br />3. Development standards shall comply with Resolution 2020-8 and 2020-9, as amended. <br />4. The developer shall comply with all conditions outlined in the City Engineer's memo <br />dated February 1, 2022, and revisions required in "redlined" comments from the City <br />Engineer. <br />5. Outlot use and ownership: <br />a) Outlot A is is proposed for stormwater management, wetlands, a trail, and common <br />space for the development. The outlot is unbuildable. The landscaping and amenities <br />on the outlot will be maintained by the homeowners association The outlot shall be <br />deeded to the City at the time the plat is recorded. <br />b) Outlot B is proposed for future phases of the development and will remain in <br />ownership of the developer. <br />
