Agreement for Goodview Estates West, subject to review and approval by the City Attorney. <br /> <br />G.16 Approve Wetland Replacement Plan for Goodview Estates <br /> <br />Integrity Homes is proposing to develop a 70 acre property into the Goodview Estates <br />development. The development will include 59 single family residential lots. The property has <br />33.4 acres of wetlands on site. The development will result in .53 acres of wetland impact, <br />mostly for road construction and grading. The applicant is proposing to replace the impacts to the <br />wetland basin though the purchase of wetland credits from an approved wetland bank. Staff <br />recommends approval of the wetland replacement plan, subject to final Technical Evaluation <br />Panel issuance of the Notice of Decision for the wetland replacement application. <br /> <br />G.17 Approve Zoning Amendment to Shoreland Ordinance <br /> <br />The Shoreland District is an overlay district in the City of Hugo. Overlay districts are <br />superimposed over zoning districts and are areas within the City that have special regulations <br />applied to them because of their unique characteristics. The Shoreland District of the City is land <br />that is within 1,000 feet of the ordinary high water (OHW) level of the lakes, ponds, and <br />flowages, and within 300 feet of the OHW level of the rivers and streams listed in the shoreland <br />classification table in the ordinance. The structure setbacks in the City’s shoreland ordinance are <br />more restrictive than the State Statutes regarding shoreland setbacks that the DNR uses. In order <br />for the setbacks to align and match with the State Statutes, staff recommends approval of the <br />ordinance amending the setbacks in the shoreland ordinance. <br /> <br />G.18 Approve Encroachment Agreement for 13466 Fondant Trail North- Schleicher <br /> <br />Lauren and Brent Schleicher have requested an encroachment agreement to allow construction of <br />a fence within a drainage and utility easement on property located at 13466 Fondant Trail North. <br />The Senior Engineering Technician has reviewed the location of the fence and is comfortable <br />with the request. Staff has reviewed the request and recommends that the City Council approve <br />the encroachment agreement for the property located at 13466 Fondant Trail North. <br /> <br />H.1 Public Hearing on an Off-Sale Liquor License for Brian Mottaz for 14849 Forest <br />Boulevard (Sager Liquor) and Approval of Tobacco License <br /> <br />Brian Mottaz, 5359 Nottingham Road, North Branch, has applied for an Off-Sale Liquor License <br />for 14849 Forest Boulevard, Unit #1, currently Sager’s Liquor. After 20 years in business, Terry <br />Sager is selling the business to Mottaz, who will reopen as Mottaz’s Bottle Shop. Mottaz has <br />paid all fees and licenses and passed the background check. Hugo City Code requires a public <br />hearing be held to consider new off-sale licenses. Staff recommends Council hold the public <br />hearing and approve the Off-Sale Liquor License for Brian Mottaz at 14849 Forest Boulevard. <br />Additionally, Mottaz is requesting approval of a Tobacco License for the store. Staff <br />recommends Council approve the Tobacco License for Mottaz Bottle Shop. <br /> <br /> <br />
