Density bonuses are also available to developers who preserve natural resource <br />features such as the greenway or buffers around wetlands. The City will continue to work <br />to implement this measure. <br /> <br />13. Through zoning and MUSA boundary determinations, the ten-acre lots will be maintained <br />under Option C. This will assist in the maintenance of the grassland and wetland complexes <br />near Elmcrest Avenue by preventing higher density development in this area. This activity <br />has occurred and will continue to occur. <br /> <br />14. Blanding’s turtles have been reported in some locations of the study area. The City will <br />provide the Blanding’s turtle information sheets to the contractors working in the study area. <br />Further, the City will consider oversizing culverts to provide crossings for Blanding’s turtles <br />provided that the size of the culvert does not conflict with the requirements of the Rice Creek <br />Watershed District and the City’s stormwater model. This activity has occurred and will <br />continue to occur. <br /> <br />15. If Blanding’s turtles are encountered during construction activity, the contractor will be <br />required to move turtles that are in harm’s way. Guidance will also be provided indicating <br />that if turtles are in harm’s way, they should be moved the closest safe area. Turtles that are <br />not in imminent danger shall be left undisturbed. This activity is ongoing. <br /> <br />16. UPDATED: Silt fence will be removed after the disturbed area has been revegetated to <br />minimize impact to turtle movement. Additionally, alternative sediment control measures that <br />reduce impact to Blanding’s turtles and other wildlife should be considered with develo pment <br />plans. This activity is ongoing <br /> <br />Since development of the original AUAR, the DNR has established additional <br />requirements for projects in the vicinity of known blandings turtle occurrences, <br />including requirement for the use of ‘bio-netting’ or ‘natural-netting’ erosion control <br />blanket, avoidance of impacts to aquatic resources suitable for hibernation between <br />October 15 and April 15, maintenance drawdowns of stormwater basins prior to <br />September 15, and site checks for turtles prior to construction. <br /> <br />17. REVISED: Wetland impacts will be subject to State and Federal wetland rules. Impacts are <br />also subject to the City’s shoreland and floodplain zoning ordinances. Wetland impacts will <br />first be avoided as feasible. If avoidance is not feasible, wetland impacts will be minimized <br />and reduced. Any remaining wetland impacts will be mitigated within the study area in <br />accordance with the Wetland Conservation Act. The original AUAR indicated mitigation <br />would be on-site, as the State rules guided mitigation to be on site. Since that time, <br />the WCA rules have changed to favor purchase of banking credits. Therefore, this <br />item has been revised. <br /> <br />18. Prior to providing outlets to landlocked areas, the City will evaluate the impact of these <br />outlets on downstream areas in conformance with City policies. City policy states the <br />following: <br /> <br />“The City of Hugo may provide an outlet to landlocked basins, provided that the discharge <br />rate from these basins does not exceed the critical duration 100-year storm, that it can be <br />demonstrated that this discharge will not significantly impact the downstream flood profile, <br />wetlands will not be drained (unless exempt as per the Wetland Conservation Act), and dead <br />water storage to retain runoff from back-to-back 100-year, 24-hour rainfall events is <br />provided. This activity has occurred and will continue to occur. <br />
