The City will comply with its own standards, ordinances, plans, and policies referred to in the <br />AUAR in the review and approval of all development activities within the Everton Avenue <br />AUAR study area. This activity has occurred and will continue to occur. <br /> <br />4. Based on EQB rules, the City will update the Everton Avenue AUAR based on Minnesota <br />Rules 4410.3610 Subpart 7 if after five years all development in the study area has not been <br />approved by the RGU, or if certain conditions or assumptions change, including land use <br />classifications and/or development densities. This is being accomplished through this <br />AUAR Update. <br /> <br />5. Developers or City will be required to obtain the necessary permits for any development <br />scenario. It is anticipated that the permitting process will be one tool for the implementation <br />of the mitigation outlined in this AUAR. It is anticipated that many of the permits will be the <br />responsibility of the developer to obtain including wetland alteration permits and stormwater <br />management permits as the City is not anticipating constructing the stormwater <br />management plan as a City project. It will be the responsibility of the project proposer to <br />obtain all necessary permits. This activity has occurred and will continue to occur. <br /> <br />6. The City of Hugo will continue to cooperate with the City of Lino Lakes, as appropriate, to <br />minimize environmental impacts and work towards compatible land uses along the Cities’ <br />borders. The two cities continue to coordinate as necessary. <br /> <br />7. Development in the study area is required to conform to State standards associated with <br />dealing with hazardous materials or storage tanks that may be encountered during <br />construction activity. This activity has occurred and will continue to occur. <br /> <br />8. Wetlands within each proposed development site will be delineated by a trained wetland <br />professional in accordance with the 1987 Corps of Engineers Wetlands Delineation Manual <br />and the regional supplements. The developers will be responsible for obtaining these <br />delineations. This activity has occurred and will continue to occur. <br /> <br />9. Any wetland impacts will be subject to the Wetland Conservation Act and Section 404 rules <br />involving sequencing and mitigation. This activity has occurred and will continue to <br />occur. <br /> <br />10. REVISED: Wetland mitigation will be completed either on-site or through the purchase of <br />bank credits as required by State and Federal rules. The original AUAR indicated <br />mitigation would be on-site, as the State rules guided mitigation to be on site. Since <br />that time, the WCA rules have changed to favor purchase of banking credits. <br />Therefore, this item has been revised. <br /> <br />11. The greenway corridor as generally shown on Figure 9 (in the 2002 AUAR) will be <br />preserved and maintained to provide habitat to mitigate for areas that may be lost through <br />development and impacts associated with the collector roads. This corridor will also act to <br />preserve significant existing natural resources within the study area such as the forested <br />areas along portions of the ditch. The City will continue to work to implement this <br />measure. <br /> <br />12. The City intends to implement the greenway corridor through a variety of mechanisms. The <br />City has a 10 percent park dedication requirement that will be used to obtain greenway <br />corridor as development plans are reviewed and approved. Further, grant applications and <br />direct purchase could be used as funds and willing sellers become available. The greenway <br />will also be implemented through negotiations with developers at the time of development
