Once the floodplain revisions are approved, the City will work towards revising the floodplain <br />ordinance, if necessary. The City will continue to work on this item. <br /> <br />28. No development within the floodplain will be permitted by the City as indicated in the City’s <br />floodplain ordinance. If encroachment within the floodplain is proposed, both the City and the <br />Rice Creek Watershed District require compensatory mitigation at a 1:1 ratio for the lost <br />storage. This measure has been followed and will continue to apply. <br /> <br />29. COMPLETED: Structures will not be constructed within areas that are proposed to be <br />removed from the floodplain until the floodplain revisions are approved. The City will <br />continue to work with FEMA to complete these revisions. Item removed as it has been <br />completed. <br /> <br />30. Development within the study area shall be required to conform to the City’s shoreland <br />zoning and floodplain ordinance. This measure has been followed and will continue to <br />apply. <br /> <br />31. UPDATED: Erosion and sedimentation control will be required to conform to City and RCWD <br />standards. Erosion control measures will be included in the developer’s agreement. Erosion <br />control measures will be consistent with Best Management Practices as outlined by the <br />Minnesota Pollution Control Agency. This measure has been followed and will continue <br />to apply. <br /> <br />The City will also encourage developers incorporate native plants and seed mixes into <br />vegetation plans. <br /> <br />32. The filling of large areas of unsuitable soil for residential construction will not be permitted <br />within the study area. This measure has been followed and will continue to apply. <br /> <br />33. The City does not intend to discharge untreated stormwater to natural wetland complexes or <br />designated stream corridors as part of development within the study area. However, if <br />impacts to wetlands are proposed as part of development, they will be evaluated in <br />accordance with the Wetland Conservation Act. This measure has been followed and will <br />continue to apply. <br /> <br />34. City policy and the RCWD require that post-development discharge rates not exceed pre- <br />development discharge rates. Development will be required to meet these standards. This <br />measure has been followed and will continue to apply. <br /> <br />35. UPDATED: The City will work with the RCWD to address the District’s interest in providing <br />volume control standards to the two-year, 24-hour rainfall event. This measure has been <br />followed where soil conditions allowed. With the new 2020 RCWD Rules, the City will <br />follow the 2020 RCWD Rules for new development to implement volume control <br />standards of up to 1.1-inch of runoff from new impervious surfaces for non-public <br />linear development. Public linear projects will be required to provide the larger of <br />either of 1.0-inches of runoff from the new impervious surface or 0.5-inches of runoff <br />off of the sum of new and reconstructed impervious. The City will continue to work <br />with RCWD to renew the joint Memorandum of Understanding transferring the <br />permitting authority to the City. The original Memorandum of Understanding <br />transferring permitting authority was completed and does not outline a renewal <br />process. <br />
