RESOLUTION NO. ______ <br /> <br />A RESOLUTION RECEIVING THE FEASIBILITY REPORT AND <br />SETTING THE PUBLIC HEARING FOR THE <br />2023 BIRCH TREE PONDS AREA STREET IMPROVEMENTS <br /> <br />WHEREAS, pursuant to resolution of the Council adopted July 5, 2022, a report was prepared by WSB, <br />with reference to the improvement of the Birch Tree Ponds subdivision streets including Foxhill Avenue <br />North, 138th Street North, Geneva Avenue North, 135th Street North, 135th Court North, Freeland <br />Avenue North, Freeland Court North and Fountain Ave north and south of Egg Lake Road; and <br /> <br />WHEREAS, the following improvements are proposed: <br /> <br /> Partial road reconstruction for Foxhill Avenue North, 138th Street North, Geneva Avenue North, <br />135th Street North, 135th Court North, Freeland Avenue North, Freeland Court North and <br />Fountain Ave north of Egg Lake Road <br /> Mill and overlay improvements on Fountain Ave south of Egg Lake Road <br /> <br />and to assess benefited properties for all or a portion of the improvement, pursuant to Minnesota Statutes, <br />Chapter 429; and <br /> <br />WHEREAS, the City Council has been advised by the City Engineer that said street improvements are <br />feasible, and should best be made as proposed, and the City Engineer’s report to this effect has heretofore <br />been received by Council, and filed with the City Clerk on October 17, 2022; and <br /> <br />WHEREAS, the City Council deemed it necessary and expedient that the City of Hugo, Minnesota, <br />construct certain improvements, to-wit: 2023 Birch Tree Ponds Area Street Improvements, in the City as <br />described in and in accordance with the feasibility report prepared by the City Engineer; and <br /> <br />WHEREAS, the statute provided that no such improvements shall be made until the Council has held a <br />public hearing on such improvements following mailed notice and two publications thereof in the official <br />newspaper stating time and place of the hearing, the general nature of the improvement, the estimated <br />costs thereof, and the area proposed to be assessed, in accordance with the law; and <br /> <br />NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Hugo that the public <br />hearing be scheduled to consider 2023 Birch Tree Ponds Area Street Improvements, to be held on <br />Monday, November 21, 2022, at 7:00 o’clock p.m. or as soon thereafter as possible, at Hugo City Hall, <br />14669 Fitzgerald Avenue North. <br /> <br />This resolution was adopted by the City Council of the City of Hugo on the 17th day of October 2022, by <br />a vote of Ayes and Nays. <br /> <br /> <br /> <br /> <br /> Tom Weidt, Mayor <br /> <br /> <br />ATTEST: <br /> <br /> <br /> <br />Michele Lindau, City Clerk <br /> <br />
