RESOLUTION 2022-___ <br /> <br />APPROVING FINDINGS OF FACT FOR REZONING TPP. LLC c/o SUMMIT <br />MANAGEMENT, LLC FOR PROPERTY LOCATED SOUTH OF 152ND STREET <br />AND EAST OF HIGHWAY 61 <br /> <br /> <br />WHEREAS, TPP, LLC c/o Summit Management, LLC, has requested reclassification of <br />the zoning from Low Density Multiple Family Residential (R-4) and General Industrial <br />(I-3) to Medium Density Multiple Family Residential (R-5). The property is legally <br />described as follows: <br /> <br />(See Attached) <br /> <br />WHEREAS, the Planning Commission has reviewed the request at a duly called Public <br />Hearing and recommends approval, and; <br /> <br />WHEREAS, the City Council has adopted an ordinance rezoning the affected parcels <br />from R-4 and I-3 to R-5; <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request <br />by Premier Bank, have requested reclassification of the zoning from Low Density <br />Multiple Family Residential (R-4) and General Industrial (I-3) to Medium Density <br />Multiple Family Residential (R-5), based on the following findings: <br /> <br /> <br />a. If the comprehensive plan amendment is approved, the zoning will be in <br />compliance with the comprehensive plan. <br /> <br />b. The buildings and site area arranged to accommodate the proposed use in <br />regards to parking, access, and building placement. The proposed zoning <br />classification is appropriate for the property because there are no <br />topographic, environmental, or cultural limitation of the site. <br /> <br />c. The property is adjacent and gets access from Highway 61. The site <br />currently has four access onto Highway 61 and will be eliminating two <br />with the project. The property can be adequately served with the access <br />proposed. The property is served by city sewer and water. <br /> <br />d. Industrial users in the industrial park are allowed exterior storage and <br />buildings up to 50 feet in height. The proposed amendment to High <br />Density Residential (HD) will provide a good transition between the <br />properties guided Industrial (IND) and Medium Density Residential (MD). <br />The proposed zoning will not have unreasonable negative impacts on the <br />neighboring properties.
