Xcel Energy <br />Page 8 <br />the property covered by the original conditional use permit and subsequent amendments, a <br />conditional use permit amendment is required. <br /> <br />The spirit and intent of the ordinance is to allow exterior storage larger than the principal <br />building, provided that it is adequately screened from view of adjacent properties. The applicant <br />is proposing to screen the outdoor facilities by way of existing mature wooded area, fencing, and <br />the proposed approximately 35,000 square foot building on site. Staff is comfortable with the <br />proposed location of the transmission lines and substation, and is of the opinion that they will be <br />adequately screened. <br /> <br />The 2040 Comprehensive Plan identifies this property for Business Park (BP) use. The character <br />of the surrounding area is industrial in nature. There are buffers of mature woodland and <br />proposed landscaping that create separation between the site and nearby residential properties. It <br />is in staff’s opinion that the proposed use will not alter the character of the surrounding area. <br /> <br />Staff is of the opinion that the request meets all of the requirements to approve a conditional use <br />permit amendment. <br /> <br />7. EASEMENT VACATION: <br /> <br />The city maintains a drainage and utility easement for the delineated 0.39 acres of wetlands on <br />site. The applicant is proposing to impact the wetlands for the construction of the new building, <br />training facilities, and stormwater management infrastructure. Pending the approval of wetland <br />replacement plan by the TEP, the wetlands will be filled and the City’s need for a drainage and <br />utility easement will be eliminated. Staff is of the opinion that the applicant meets the <br />requirements to approve an easement vacation, subject to approval by the TEP. <br /> <br />8. CONCLUSION: <br /> <br />Staff finds that the proposal meets all the requirements necessary for the City to approve the site <br />plan, CUP amendment, variance, and easement vacation as outlined in the City Code and zoning <br />district regulations, subject to the conditions listed in the attached resolutions. <br /> <br />9. STAFF RECOMMENDATION: <br /> <br />Staff recommends approval of the site plan, CUP amendment, variance, and easement vacation <br />subject for Xcel Energy on the property located at 13620 Fenway Boulevard North. <br /> <br />10. PLANNING COMMISSION RECOMMENDATION: <br /> <br />The Planning Commission unanimously recommended approval of the Site Plan, CUP <br />Amendment, Variance, and Easement Vacation applications for Xcel Energy on the site located <br />at 13620 Fenway Boulevard North, subject to the conditions in the resolutions. <br /> <br />ATTACHMENTS: <br /> <br />1.
