Applicant will coordinate with and get agreements for all encroachments and work within the <br />large Xcel Energy easement through the site. <br /> <br />Stormwater Management <br /> <br />9. The site is meeting water quality requirements primarily through water reuse for onsite <br />irrigation. The remaining water quality required will be provided by the stormwater ponds <br />onsite. <br />a. Applicant should provide documentation noting that the water quality treatment <br />needed for Phase 1 is being provided by either the irrigation system that will be <br />constructed as part of Phase 1 and/or the ponding onsite that is being constructed as <br />part of Phase 1 to confirm water quality requirements are being met in the interim <br />condition. <br />10. The site is meeting rate control requirements through the stormwater ponds onsite. <br />11. Additional permitting with both RCWD and DNR Floodplain/FEMA is required for the culvert <br />crossing in the ditch. The applicant has noted coordination for both permits is underway. <br />a. While it is not a public ditch, the private ditch is considered a Regional Conveyance <br />System under RCWD’s definitions and will requires a Rule G permit administered by <br />RCWD. The Rule G permit must be obtained prior to the start of construction on the <br />culvert crossing. <br />b. The Minnesota DNR staff has noted a LOMR for the crossing will be required within 6 <br />months of the crossing construction. <br />12. While the information previously reviewed confirms the viability of the stormwater reuse <br />system, additional detail on the irrigation system is needed for review. Details on where the <br />intake pipe will be laid and at what elevation, in addition to the location of the main line for <br />irrigation should all be provided as the project moves forward. An irrigation plan has not been <br />received for the development as a whole or for Phase 1. <br />13. Additional detailed redline drainage comments have been provided to the applicant and will <br />need to be addressed prior to the issuance of the stormwater permit. <br /> <br />Wetlands <br /> <br />14. While not part of the plat plans, the applicant is encouraged to submit a drawing and narrative <br />describing the installation of hydrology monitoring equipment for wetlands 2,3, and 6 prior to <br />the 2023 growing season as required under condition 1 of the wetland replacement approval <br />issued on June 24, 2022. <br />15. Condition 4 of the replacement plan approval states that the approval itself is contingent on a <br />take permit being issued by MN DNR or other agencies. The last correspondence from the <br />applicant’s representative stated that there has been no response from the MN DNR since <br />8/2/22. A take permit will be required prior to any ground disturbance activities. The <br />purchase of replacement credits has been held up due to this as well. Replacement credits <br />need to be debited from the approved wetland bank (#1762) prior to impacting wetlands. <br />16. Prior to constructing the trail crossing wetland 6 east of the intersection of 158th Blvd and <br />Street G, details on the boardwalk will need to be provided for approval by the Hugo <br />Technical Evaluation Panel (Condition #5 of the Replacement Plan approval). <br /> <br />
