BWSR NOD Form – November 12, 2019 2 <br /> <br />Wetland boundary and types were approved in March 2023 and two (2) Type 1 (PEM1A) wetlands were <br />delineated. <br /> <br />Sequencing <br /> <br />The applicant requested sequencing flexibility be applied to the project given the degraded nature of the <br />wetlands. The applicant considered five (5) alternatives for the proposed project, including the No Build and <br />four (4) alignment alternatives. The no build would result in no access to the residential development. Access <br />must be provided so this is not a feasible alternative. The alignment alternatives would each have impacted <br />wetland to varying degrees. Two (2) of the four (4) alternatives were rejected because they would not provide <br />various facilities requested by the city (sidewalk, access to lift station) and one (1) was rejected because it <br />impacted more wetland than the preferred alternative. The applicant minimized impacts to the wetlands <br />through realignments of the street and sidewalks. A detailed discussion of this alternatives analysis and <br />minimization efforts may be found in Attachment C of the Wetland Permit Application document dated March <br />2023 and meets requirements of MN Rule 8420.0520. <br /> <br />The preferred alternative includes two (2) separate wetland impact areas resulting in a total of 0.31 acre <br />(13,549 square feet) of wetland impact all due to wetland fill. This alternative extension/construction of <br />Oneka Parkway by 1,000 feet as well as construction of a bicycle path and sidewalk. An illustrated figure of this <br />proposed alternative can be found on page 22 of the permit application and is titled “Oneka Parkway Wetland <br />Impact Exhibit” and details the 13,549 square feet of impact. <br /> <br />Replacement <br /> <br />The proposed alternative will result in 0.31 acres of permanent wetland impact in the form of wetland fill. <br />The required replacement ratio is reduced from 2.5:1 to 2:1 as the applicant will be required to replace within <br />the same Major watershed (MS-Metro-#20) and same BSA, which is BSA #7. To meet this requirement, the <br />applicant is proposing to replace these impacts through the purchase of 0.62 acres of wetland credit from <br />Bank #1772. Wetland Bank #1772 is located in the same major watershed and BSA. No wetland credits are <br />available in the same minor watershed as the impacted wetland. <br /> <br />Special Considerations <br /> <br />The applicant has addressed and submitted information on each of the special considerations identified in MN <br />Rule 8420.0515. These include: <br /> <br />• Endangered and threatened species <br />• Rare natural communities <br />• Special fish and wildlife resources <br />• Archeological, historic, and cultural resources <br />• Groundwater sensitivity <br />• Sensitive surface waters <br />• Education or research use <br />• Waste disposal sites <br />• Consistency with other plans <br /> <br />The applicant reviewed and submitted data to determine that the project would have no effect on protected <br />species or rare natural communities. The applicant contends that they have no knowledge concerning the <br />remaining special consideration or content that this project will not adversely impact them. No impacts to <br />special considerations are approved under this Notice of Decision, rather this decision applies only to MN Rule <br />8420.
