<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />ENCROACHMENT AGREEMENT <br /> <br /> <br /> THIS AGREEMENT is made this 6th day of November, 2023 by and between the CITY OF <br />HUGO, a Minnesota municipality (hereinafter “City”) and, Hunter Smith and Brayanna Smith, a <br />married couple, hereinafter “Owners”), and its successors in title. <br /> WHEREAS, the City has a tract of right-of-way (the “Right-of-way”) to the east of the <br />Owner’s property, which is legally described as: <br /> <br />Lots 7, 8, 9, 10, 22, 23, and 24, Block 7, Shadyside No. 4, Washington County, Minnesota. <br /> <br /> WHEREAS, Owner is desirous of constructing a fence partially within the right-of-way area; <br />and, <br /> WHERAS, the City will permit the placement of a fence in the area described herein subject <br />to the terms and conditions hereof. <br /> NOW, THEREFORE, in consideration of the premises and for good and valuable <br />consideration, the receipt of which is acknowledged, the City will permit the encroachment on its <br />right-of-way as set forth herein and subject to the conditions set forth below:
