Council Meeting Minutes for April 17, 2023 <br />Page 5 of 6 <br />Reminder – Metro Cities Annual Meeting on April 19, 2023 <br />City Administrator Bryan Bear reminded Council they had scheduled a meeting to attend the <br />Metro Cities Annual Meeting on April 19, 2023, at the Roseville Skating Center from 5-7 p.m. <br />Executive Session-McCullough v. City of Hugo <br />City Attorney Dave Snyder recommended Council adjourn to Executive Session as permitted by <br />Minn. Stat. § 13D.05, subd. 3(b) for the purpose of providing legal advice regarding pending <br />litigation in the matter Ryan McCullough v. City of Hugo. <br />Weidt made motion, Klein seconded, to recess the open meeting and enter into Executive <br />Session at 7:15 p.m. <br />All Ayes. Motion carried. <br />Miron made motion, Klein seconded to enter back into regular open session at 7:53 p.m. <br />All Ayes. Motion carried. <br />City Attorney Dave Snyder explained the Council met in Executive Session to discuss pending <br />or threatened litigation in the matter of Ryan McCullough v. City of Hugo. The Council met <br />under the exemption to the Open Meeting Law under the recommendation of the City Attorney. <br />He had presented Council with a proposed Severance Settlement Agreement and Release of <br />Claims. This came with a recommendation from the City Attorney to approve this agreement <br />that would result in making certain payments to McCullough in connection with alleged conduct <br />of a former employee. Present in the executive session in addition to Council were: City <br />Administrator Bryan Bear, City Attorney Dave Snyder, Public Works Director Scott Anderson, <br />City Clerk Michele Lindau, League of Minnesota Cities Defense Attorney Hannah Felix, and <br />League of Minnesota Cities Insurance Trust Claims Adjuster Joseph Neubauer. The City <br />Attorney requested Council make a motion to approve the Severance and Settlement Agreement <br />and Release of Claims relating to Ryan McCullough pursuant to modifications and finalization <br />steps to be taken by the City Administrator. <br />Weidt made motion, Klein seconded, to approve the motion as stated by the City Attorney. <br />Roll call vote: <br />Ayes: Klein, Miron, Strub, Weidt <br />Nays: None <br />Motion carried.
