Liberty Classical Academy Site Plan and CUP <br />Page 5 <br />A. The proposed use is permissible by law. <br />The use is permissible by law. <br />B. The proposed use is in keeping with the spirit and intent of this chapter. <br />The spirit and intent of the ordinance is to allow a school in the Agricultural zoning district as a <br />conditional use. The performance standards requires the school to have its principal entrance <br />from a state highway, county road, or city collector street. The school’s principal access will be <br />from County Road 57/Keller Avenue. The project meets the spirit and intent of the ordnance. <br />C. The proposed use is compatible with the city's comprehensive plan, and the character of the <br />surrounding area. <br />The property is guided as Public/Quasi Public and Agricultural in the 2040 Comprehensive Plan. <br />The types of development anticipated to be located in Public/Quasi Public include schools, <br />libraries, community centers, places of worship, play fields, and parks. The types of development <br />anticipated to be located in Agricultural include farms, horse stables and riding areas, livestock, <br />such as cows and pigs, and open space. <br />Schools are allowed in the Agricultural zoning district in the City Code. The location has been a <br />school for several years. The applicant is requesting approval of an approximately 33,500 square <br />foot addition. The total square footage is approximately 66,500 square feet, typical size of an <br />elementary school. The applicant is preserving trees and providing transitions from property lines <br />to the school. <br />The school is compatible with the comprehensive plan and character of the surrounding areas. <br />D. The proposed use has adequate drainage, water supply, electrical, gas, and sewage <br />treatment facilities. <br />The school will have adequate drainage, water supply, electrical, gas, and septic service. <br />E. The proposed use has adequate road access, and does not reduce the safety or capacity of the <br />public road system. Road access shall be no lower than the regional flood elevation. <br />The access to the school will be from CR 57/Keller Avenue and is controlled and managed by <br />Washington County. The applicant has been working with Washington County on the access <br />location and intersection improvements that will include corresponding turn lanes. The school <br />will have adequate road access. <br />F. The technical evaluation of the floodplain, if required, accurately represents the conditions <br />and boundaries of the floodplain area, as well as correctly represents the proposed use's <br />impact on the floodplain. <br />There is floodplain is located on the north east portion of the site and is not proposed to be <br />impacted.
