RESOLUTION 2024- <br /> <br />APPROVING A SITE PLAN, CONDITIONAL USE PERMIT, AND <br />DEVELOPMENT AGREEMENT FOR LIBERTY CLASSICAL ACADEMY <br />SCHOOL TO ALLOW AN ADDITION ON THE EXISTING SCHOOL <br />LOCATED AT 10158 122ND STREET NORTH <br /> <br />WHEREAS, Liberty Classical Academy has requested approval of a site plan and <br />conditional use permit (CUP) for an approximately 33,500 square foot addition and <br />additional parking to be constructed on to the existing school on property located at <br />10158 122nd Street North that is legally described as follows: <br /> <br />See attached. <br /> <br />WHEREAS, the Planning Commission has reviewed said site plan and CUP on May 9, <br />2024, and recommends approval subject to the conditions listed in this resolution. <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the site <br />plan and CUP for Liberty Classical Academy with the following findings and conditions: <br /> <br />Findings: <br /> <br />1. The use is permissible by law. <br /> <br />2. The spirit and intent of the ordinance is to allow a school in the AG zoning district as a <br />conditional use. The performance standards requires the school to have its principal <br />entrance from a state highway, county road, or city collector street. The school’s <br />principal access will be from County Road 57/Keller Avenue. The project meets the <br />spirit and intent of the ordnance. <br /> <br />3. The property is guided as Public/Quasi Public and Agricultural in the 2040 <br />Comprehensive Plan. The types of development anticipated to be located in <br />Public/Quasi Public include schools, libraries, community centers, places of worship, <br />play fields, and parks. The types of development anticipated to be located in <br />Agricultural include farms, horse stables and riding areas, livestock, such as cows and <br />pigs, and open space. <br /> <br />4. School are allowed in the Agricultural zoning district and the Public/Quasi Public land <br />use in the 2040 Comprehensive Plan. The location has been a school for several years. <br />The applicant is requesting approval of an approximately 33,500 square foot addition. <br />The total square footage is approximately 66,500 square feet, typical size of an <br />elementary school. The applicant is preserving trees and providing transitions from <br />property lines to the school. The school is compatible with the comprehensive plan <br />and character of the surrounding areas. <br /> <br />5. The school will have adequate drainage, water supply, electrical, gas, and septic <br />service.
