Page 2 <br /> <br /> <br /> 2 <br />The properties to the north, west, and south are zoned and guided as Agricultural and consist of <br />large lots occupied by single family homes and agricultural uses. The properties to the east are <br />located in May Township and are zoned Rural Residential. <br /> <br />B. Natural Characteristics of Site <br /> <br />The site is approximately 10 acres in size, and the property owner also owns the adjoining 10 <br />acre parcel to the north. The property has some sloping terrain with the house being located on <br />the highest point of the site. There is some wetland on the eastern portion of the property that <br />will not be impacted by this request. There are also a number of trees that provide screening from <br />view of the road. <br /> <br />4. ANALYSIS: <br /> <br />A. Level of City discretion in decision-making <br /> <br />The City’s discretion in approving or denying a conditional use permit is limited to whether or not <br />the proposed application meets the standards outlined in the Zoning Ordinance. If it meets these <br />standards, the City must approve the conditional use permit. <br /> <br />B. Accessory Apartment <br /> <br />Performance Standards <br /> <br />1. Accessory Apartments must comply with the city building code and the rules of the county <br />health department. <br /> <br />The applicant must obtain a building permit if the CUP request is approved. Prior to the issuance <br />of a building permit, the applicant must obtain any necessary permits from Washington County. <br />These are included as conditions in the CUP. <br /> <br />2. The structure in which an accessory apartment is located must be owner-occupied. <br /> <br />The accessory apartment is proposed to be attached to an owner-occupied single-family home. <br /> <br />3. No separate driveway or curb cut shall be allowed for an accessory unit. <br /> <br />The accessory apartment will be served by the existing driveway. <br /> <br />4. There shall be no more than one accessory apartment within any single-family structure. <br /> <br />The applicant is not proposing any additional accessory apartments. <br /> <br />5. The accessory apartment may not be located in or above a garage or other accessory building <br />except in the agricultural zoning district. <br />
