<br />8 <br /> <br />ordinance are met. <br />b. The registration is currently suspended by the city. <br />c. The cannabis business no longer holds a valid license <br />issued by the state office of cannabis management. <br />d. The renewal application does not meet the requirements of <br />this ordinance, or any other applicable rule or law. <br />e) Suspension of Registration <br />1. Violations – Any violation of this ordinance, or any applicable rule <br />or law, shall be deemed to be an administrative offense of the <br />registration holder, and the registration holder shall be subject to <br />the administrative penalties set forth in the city fee schedule for <br />cannabis businesses. The administrative penalty amount shall be <br />calculated against all offenses occurring within a 36 consecutive <br />month period from the date of the most recent violation. Any <br />violation having occurred beyond 36 consecutive months prior to <br />the most recent violation shall not be counted in terms of imposing <br />the fee. Penalties shall be paid within 60 days of the time of <br />issuance of the notice. <br />2. When Suspension is Warranted – The City of Hugo may suspend a <br />cannabis business registration, after notice and an opportunity for <br />hearing when reasonably available, if it violates a city ordinance or <br />poses an immediate threat to the health or safety of the public. The <br />city shall promptly notify the cannabis business in writing the <br />grounds for the suspension. <br />3. Notification to the state – The City of Hugo shall immediately <br />notify the state office of cannabis management in writing the <br />grounds for the suspension, who shall in turn provide the city and <br />cannabis business a response to the complaint within seven <br />calendar days, and perform any necessary inspections within 30 <br />calendar days. <br />4. Length of suspension – The suspension of a cannabis business <br />registration may be up to 30 calendar days, unless the state office <br />of cannabis management suspends the license for a longer period. <br />The business may not make sales to customers if their registration <br />is suspended. The city may reinstate a registration if it determines <br />that the violation(s) have been resolved. The city shall reinstate a <br />registration if the state office of cannabis management determines <br />that the violation(s) have been resolved. <br />5. Subject to Minn. Stat. 342.22 Subd. 5(e), the city may impose a <br />civil penalty, as specified in the city fee schedule, for registration <br />violations. The penalty shall not exceed the maximum allowed by <br />state law. <br />f) Limiting of Retail Registrations -- the City of Hugo shall limit the <br />number of cannabis retail registrations to one registration for every 12,500 <br />residents. This limit shall include registrations for cannabis retailers and the <br />retail location(s) of a cannabis microbusiness or cannabis mezzobusiness. <br />This limit shall not extend to lower-potency hemp edible retailers and the
