<br />G.17 Approve Authorization for Amendments to the Fence Ordinance <br /> <br />Section 90-227 of City Code outlines requirements for fences but does not have a process for <br />placing a fence within a drainage and utility easement. New residential developments in the City <br />of Hugo are required to dedicate easements for drainage and utility purposes around the <br />perimeter of single-family lots. When a resident is constructing a fence on their property line, <br />they are almost always going to be locating the fence within the easement. Staff has been <br />requiring that residents constructing a fence within an easement request an Encroachment <br />Agreement from the City Council, which lengthens the approval process for a fence. The <br />agreement allows the resident to construct a fence within the easement, and states that if the City <br />needs to perform construction work within the easement that the fence may be removed at the <br />owner’s expense. Staff has identified a need to codify that a fence placed within an easement <br />may be removed at the owner’s expense, which would streamline the approval process by <br />permitting encroachments administratively. Staff is requesting authorization from the City <br />Council to work with the City Attorney on drafting text amendments to the fence ordinance, and <br />to hold a public hearing on the text amendments with the Planning Commission. <br /> <br />G.18 Approve Resolution to Close the Coronavirus Relief Fund and Transfer Investment <br />Income <br /> <br />The Governmental Accounting Standards Board (GASB), along with the City’s auditors, <br />recommend closing fund accounts when the intended use of those accounts no longer exist. As <br />of December 31, 2024, all Coronavirus Relief Funding has been expended and properly reported. <br />Investment income remained in the Fund and according to United States Treasury guidance, <br />interest earned does not need to be remitted to the Treasury nor used for specific program-related <br />expenditures. This investment income is not restricted for any specific purpose and therefore can <br />be transferred to any fund designated by the City Council.
