Kwik Trip – 159th Street <br />Page 2 <br />Parcel 1 reserved for future commercial development. The applicant is showing a “ghost” plan on <br />Parcel 1, but no approvals for development on Parcel 1 are being requested at this time. <br /> <br />3. CONTEXT: <br /> <br />A. Surrounding Land Use and Zoning <br /> <br />The properties to the east and southeast are zoned Planned Unit Development (PUD) and are parts <br />of the Shores of Oneka Lake development which includes single family homes and apartments. <br />The properties to the south along Forest Boulevard are zoned General Business (C -2) and are <br />occupied by industrial-type businesses. The properties to the west are zoned Single-Family <br />Detached Residential (R-3) and are occupied by single-family homes in the Creekview Preserve <br />development. The property to the north is also zoned R-3, is currently vacant, and is guided for <br />low density residential development.. <br /> <br />B. Existing Site Characteristics <br /> <br />The properties are currently vacant, having been graded with the Shores of Oneka Lake <br />development. There is a berm along the north property line that was created with the grading of <br />the development, and there is some terrain sloping downwards toward the east. There are no trees <br />or wetlands on the site. <br /> <br />4. ANALYSIS: <br /> <br />A. Level of City Discretion in Decision-Making <br /> <br />The City has discretion in approving or denying a comprehensive plan amendment on whether or <br />not the proposed project has impacts on regional systems including transportation, wastewater and <br />regional parks. The City has a higher level of discretion with a comprehensive plan because the <br />burden of proof is on the applicant to show that they meet the standards. <br /> <br />The City has discretion in approving or denying zoning amendment applications, based on whether <br />or not the proposed project meets the standards outlined in the Comprehensive Plan and Zoning <br />Ordinance requirements. If the City finds that all the applicable standards are met, the zoning <br />amendment application must be approved. However, if the City finds that any of the applicable <br />standards are not met, the application may be denied. <br /> <br />The City has limited discretion in approving or denying a subdivision application. The City’s <br />discretion is limited to whether or not the proposed subdivision meets the standards outlined in <br />the Comprehensive Land Use Regulations. If it meets these standards, the City must approve the <br />subdivision. <br /> <br />The City’s discretion in approving or denying a conditional use permit is limited to whether or not <br />the proposed application meets the standards outlined in the City’s Comprehensiv e Land Use <br />Regulations. If it meets these standards, the City must approve the conditional use permit. <br />
