Kwik Trip – 159th Street <br />Page 3 <br />The City’s discretion in approving or denying a site plan is limited to whether or not the proposed <br />project complies with the Comprehensive Plan and Zoning Ordinance requirements. If it meets <br />these standards, the City must then approve the site plan. <br /> <br />B. Consistency with Ordinance Standards <br /> <br />The applications comply with the ordinance standards as follows: <br /> <br />Comprehensive Plan Amendment <br /> <br />The applicant is requesting a comprehensive plan amendment to change the land use of Parcel 1 <br />from Low Density Residential (LD) to Commercial (COM), matching the current land use <br />designation of Parcel 2. <br /> <br />In review of the request, staff used the following criteria: <br /> <br />1. Evidence submitted by the applicant demonstrating the reason(s) that the plan should <br />be changed, including but not limited to whether new information has become <br />available since the Comprehensive Plan was adopted that supports re-examination of <br />the plan, or that existing or proposed development offer new opportunities or <br />constraints that were not previously considered by the Plan. <br /> <br />The property is currently guided as Low Density Residential (LD) in the 2040 Land <br />Use Plan. The property is directly adjacent to Parcel 2 which is guided Commercial <br />(COM), and across 159th Street North from property that is guided Low Density <br />Residential (LD). <br /> <br />With the creation of the Shores of Oneka Lake development, 159th Street was brought <br />through this area and separated two sections of land that were guided LD. Amending <br />the designation of the separated parcel (Parcel 1) to match its adjoining parcel (Parcel <br />2) would allow for continuity throughout the site and create a better transition of land <br />uses by separating commercial uses to one side of the street and low density residential <br />uses on the other side of the street. <br /> <br />2. Is the requested amendment needed to allow reasonable use of the site? <br /> <br />The proposed amendment to Commercial (COM) is compatible with the existing <br />commercial land use designation on the adjoining parcel, and allows for a separation <br />between land guided COM and LD by having them on opposite sides of the street. The <br />proposed amendment would allow for a more reasonable use of the site by creating <br />more continuity of compatible land uses. <br /> <br />3. The relationship of the proposed amendment to the supply and demand for particular <br />land uses within the city and the immediate vicinity of the site. <br /> <br />The site is at the northeast corner of the intersection of Forest Boulevard (Highway <br />61) and 159th Street North.
