APPENDIX C <br />EARNED SAFE AND SICK TIME (ESST) POLICY <br /> <br />Effective January 1, 2024, Sick and Safe Time is paid leave employers must provide to employees <br />in Minnesota that can be used for certain reasons as stated in Section 2.0 (b). All employees <br />working at least 80 hours in a year, excluding paid on-call firefighters, are eligible. At a minimum, <br />an employee needs to be granted one hour of ESST for every 30 hours worked to a maximum of <br />48 hours of ESST per year. For the purposes of this policy, a year is a calendar year – January 1 to <br />December 31. The hourly rate of ESST is the same hourly rate an employee earns from <br />employment with the city. <br /> <br />a) Accruing Earned Sick and Safe Leave <br />Full-time regular employees will not accrue additional ESST hours in excess of current <br />Personal Time Off accrual as the Personal Time Off Policy exceeds the requirements of <br />the ESST Law. <br /> <br />For temporary and part-time employees performing work for at least 80 hours in a year <br />for the City, hours of ESST will be one hour for every 30 hours worked up to a maximum <br />of 48 hours per year. <br /> <br />b) Earned Sick and Safe Leave Use: <br />The leave may be used as it is accrued in the smallest increment of time tracked by the <br />city’s payroll system. Full-time, part-time, and temporary employees are tracked in .25- <br />hour increments. ESST may be used as PTO in addition to the following: <br /> <br />1. An employee’s own: <br />o Mental or physical illness, injury or other health condition <br />o Need for medical diagnosis, care or treatment, of a mental or physical illness <br />injury or health condition <br />o Need for preventive medical or health care, or <br />o Need to make arrangements for or attend funeral services or a memorial, or <br />address financial or legal matters that arise after the death of a family member <br /> <br />2. Care of a family member: <br />o With mental or physical illness, injury or other health condition <br />o Who needs medical diagnosis, care or treatment of a mental or physical illness, <br />injury or other health condition, or <br />o Who needs preventative medical or health care <br /> <br />3. Absence due to domestic abuse, sexual assault or stalking of the employee or <br />employee’s family member provided the absence is to: <br />o Seek medical attention related to physical or psychological injury or disability <br />caused by domestic abuse, sexual assault, or stalking <br />o Obtain services from a victim services organization
