MINUTES OF PROCEEDINGS OF THE HUGO PLANNING COMMISSION <br /> AUGUST 13, 1974 <br /> The public hearing was opened by Veru Peloquix at 8:12 P.M. for <br /> the Hardwood Creek Estates subdivision. <br /> Robert Waller - Mr..:. Miler stated that the public notice in the <br /> Forest Lake Times was incorrect. It described a non-existing piece <br /> of land in the legal description. He also said that he came to <br /> City Hall to see the plans for Hardwood Creek Estates and it couldn't <br /> be located. He recommended that the Ordinance Committee amend the <br /> ordinance se plans are available for inspection by the public 10 days <br /> prior to the Public Hearing. He stated that the Ordinance says that <br /> adjacent communities have to be notified of a public hearing. He <br /> stated that Forest Lake had not been notified. Bill Schwab read the <br /> Ordinance for Hugo the clerk is operating with and it did not state <br /> what Mr. Waller mentioned. Spitzer suggested that the Secretary be <br /> instructed to add a sentence to the public hearing notice stating <br /> that plans are on file for public inspection and that all applicants <br /> be required to have their plans on file when the public hearing is <br /> scheduled. <br /> Vern Pel o quip read the public hearing notice. Bill Schwab read his <br /> report for the Hardwood Creek Estates. <br /> Mr. Mugg explained what his plans were: <br /> - 15 buildable lots <br /> - 177th Street can be completed. <br /> - Out lot A along Hardwood Creek will be left and a scenic <br /> easement for maintenance purposes. <br /> - An area will be left along Highway 61 for commercial development. <br /> - All lots are 300 feet wide except one. <br /> - They have spent a considerable amount of money on water control. <br /> - Rice Street Watershed has submitted a favorable report. <br /> - Kuusisto has inspected the area but has not submitted a report. <br /> - The gas company has come out and staked it and okayed the plan. <br /> Spitzer said they should obtain a written disclaimer from the <br /> Northern Natural Gas Company. Mr. Hult said that he would <br /> obtain this letter prior to going to Council. <br /> Spitzer suggested that there be 3 out lots. Lot 8 is less than 300 <br /> feet wide but is actually 10 acres. Spitzer stated that the subdivision <br /> ordinance has a section regarding street intersections. Schwab read <br /> that it could be a 60 to 90° angle. The pipe line forcep one of the <br /> driveway easements to be at an angle. <br /> Attorney Johnson asked if there is any restrictive covenants. Mr. <br /> Mugg stated that they will be using the same restrictive covenants <br /> they use in their other developments except for the side of the houses. <br /> His restrictions are stricter than the City Code. <br />
