Cemeteries. <br />(a) It is unlawful for any person to construct or operate a cemetery, or interment for the dead, except in <br />conformance with this chapter. <br />(b) The main entrance to a cemetery must be located on a minor expander, minor connector, or a major or <br />minor collector. <br />(c) Cemeteries shall be a minimum of five acres in size. <br />(d) A cemetery shall not be located so as to obstruct the future development of adequate collector streets or <br />extension of public utilities for the area in which it is located. <br />(e) Burial plots, gravemarkers, monuments, and buildings must meet building setback and height requirements <br />for the zoning district in which they are located. <br />(f) Access to cemeteries shall be limited and controlled through the use of gates or similar structures. The entire <br />perimeter of the cemetery shall be clearly delineated. <br />(g) Graves and structures used for interment shall be set back a minimum of 50 feet from all wells. <br />(h) No grave or structure used for interment shall be constructed below the regulatory flood protection <br />elevation. <br />(i) Cemeteries shall be landscaped in accordance with section 90-236. <br />(Prior Code, § 1195-140.1, § 90-214) <br />Sec. 90-209. Commercial, private, or public satellite dish. <br />(a) Satellite dishes that exceed two-meters in diameter will require a conditional use permit. <br />Sec. 90-210. Commercial recreation. <br />(a) It is unlawful for any person to construct or operate indoor or outdoor commercial recreation activities, <br />except in accordance with this chapter. <br />(b) Indoor or outdoor commercial recreation landscaping shall be planted to buffer the use from adjacent land <br />uses and provide adequate visual and noise screening. Outdoor facilities shall utilize berms, fences, or <br />natural vegetation as appropriate to reduce impacts on nearby properties. <br />(c) An operations plan shall be submitted with the conditional use permit application, including proposed hours <br />of operation, expected capacity, maintenance procedures, and security measures. Any substantial change in <br />operations may require an amendment to the conditional use permit. <br />(d) A lighting plan shall be submitted with the application for a conditional use permit. All lighting shall be <br />downcast, fully shielded, and directed away from adjacent properties and public rights-of-way. The city may <br />impose limitations on hours of illumination to minimize impacts. <br />(e) Accessory uses may include restrooms, concessions, office space, retail related to the primary recreation use, <br />and minor maintenance structures. Additional accessory uses may be permitted by the city council if <br />determined to be clearly incidental and compatible with the principal use. <br />(Prior Code, § 1195-160.1, § 90-217 (Indoor Commercial Recreation) & 90-231 (Golf Course))
