Convenience store and gas stations. <br />(a) It is unlawful for any person to construct or operate a convenience store and gas stations with prepared food <br />and/or motor fuel sales, grocery, food operations, and/or convenience motor fuel with no vehicle service or <br />repair, except in accordance with this chapter. <br />(b) Seating areas for consumption of convenience/deli food purchased on site shall be subject to City review and <br />approval, subject to the following standards: <br />(1) Seating areas shall not exceed 10 percent of the building gross floor area. <br />(2) The minimum clear passage zone for pedestrians at the perimeter of the outdoor dining area shall be <br />at least five feet without interference from tables, chairs, planters, parked motor vehicles, bollards, <br />trees, tree gates, curbs, stairways, trash receptacles, street lights, parking meters, or the like. <br />(3) Umbrellas or other structures extending into the pedestrian clear passage zone or pedestrian aisle shall <br />have a minimum clearance of seven feet above the sidewalk. <br />(4) The outdoor dining area shall be surfaced with concrete, bituminous or decorative pavers or may <br />consist of a deck with wood or other flooring material that provides a clean, attractive, and functional <br />surface. <br />(5) The outdoor dining area shall be designed to avoid potential conflict with motor vehicle <br />parking or circulation. <br />(6) Refuse containers shall be provided dining areas. Such containers shall be placed in a manner which <br />does not disrupt pedestrian circulation and must be designed to prevent spillage and blowing litter. <br />(7) The outdoor dining area shall be kept clean and otherwise maintained in an orderly, sanitary, attractive <br />condition. <br /> <br />(c) The storage, preparation and serving of food items are subject to specific written sanitary requirements <br />based upon the applicable state and county regulations. <br />(d) The proximate area and location of space devoted to nonautomotive merchandise sales shall be specified in <br />the application and in the conditional use permit. <br />(e) The off-street loading space and building access for delivery of goods shall be separate from customer <br />parking and entrances and shall not cause conflicts with customer vehicles and pedestrian movements. <br />(f) The hours of operation shall be limited to 6:00 a.m. to 11:00 p.m., unless amended by the council as part of <br />the conditional use permit. <br />(g) Motor fuel facilities shall be installed in accordance with state and city standards. Additionally, adequate <br />space shall be provided to access gas pumps and to allow maneuverability around the pumps. Underground <br />fuel storage tanks are to be positioned to allow adequate access by motor fuel transports and unloading <br />operations which do not conflict with circulation, access and other activities on the site. Fuel pumps shall be <br />installed on pump islands. <br />(h) A protective canopy located over pump islands may be an accessory structure on the property and may be <br />located 20 feet or more from the front lot line, provided adequate visibility both on and off site is <br />maintained. <br />(i) All canopy lighting for motor fuel station pump islands shall be recessed or shielded to provide a 90-degree <br />cutoff. Illumination levels for pump islands shall not exceed 30 footcandles. <br />(j) The operation shall be responsible for litter control from the premises and litter control is to occur on a daily <br />basis. Trash receptacles must be provided at a convenient location on site to facilitate litter control.
