No. 2010-453, § 3, 12-6-2010; Ord. No. 2015-470, 5-4-2015) <br />Sec. 90-251. Outdoor display of merchandise for sale. <br />(a) It is unlawful for any person to operate, or allow to be operated, any outdoor display of merchandise for sale, <br />except in conformance with this chapter. <br /> <br />(b) An outdoor display area shall involve items for sale by a business in a permanent structure, enclosure, or <br />designated area on the same site from which the business is operated. <br /> <br />(c) Sidewalk displays on private sidewalks are prohibited. <br /> <br />Sec. 90-252. Parking and loading. <br />(a) It is unlawful for any person to construct any building or facility, or to use a property, unless such property <br />shall have adequate parking, loading, driveway, and access road facilities, as required in this section. It is <br />unlawful for any person to construct any parking area, loading area, driveway or access road, except in <br />conformance with this chapter. <br />(b) The regulations of parking and loading in this section are to alleviate or prevent congestion of the public <br />right-of-way and to promote the safety and general welfare of the of the public by establishing minimum <br />requirements for parking and loading of motor vehicles upon various parcels of land and for structures. <br />(c) General standards. <br />(1) Parking areas for five or more vehicles must be approved by the city engineer prior to construction. <br />(2) Back of curb of all parking areas shall meet the following setbacks: <br />Public right-of-way 10 feet <br />Residentially zoned property 10 feet <br />All other property lines 5 feet <br /> <br />(3) No parking areas shall be constructed on a public road right-of-way or drainage and utility easement <br />without approval of the city council. <br />(4) Curb cut and driveway access locations. <br />a. Driveway access to parking areas shall comply with section 90-215, except that no parking <br />entrance may be located within 60 feet of the intersection of two public streets. <br />b. Curb cuts on state highways and county roads shall meet the requirement of the permitting <br />agency. <br />c. Accesses to a property shall be minimized to amount needed to allow proper circulation on the <br />site. As a minimum, each parcel of land shall be allowed one curb cut on a city street; otherwise, <br />one curb cut shall be allowed for each 150 feet of road frontage on a city collector street, and <br />one curb cut for each 125 feet of frontage on all other city streets. Credit for fractions of the <br />required frontage shall not be granted. In no case shall the separations be less than outlined <br />above, unless unique circumstances are present and are reviewed and approved by the <br />community development director or designee.
