<br /> <br /> <br /> Created: 2025-05-22 16:40:53 [EST] <br />(Supp. No. 36) <br /> <br />Page 147 of 198 <br />(g) No boats, recreational vehicles, automobiles, trucks, or other motor vehicles may be displayed for sale on <br />the site, except as may be authorized by conditional use permit. <br />(h) All areas utilized for storage and disposal of trash, debris, discarded parts, and similar items shall be fully <br />screened with materials consistent to those used on the principal building. All structures and grounds shall <br />be maintained in an orderly, clean, and safe manner. <br />(j) The following additional requirements applies to major motor vehicle repair businesses: <br />(1) Servicing of motor freight vehicles and heavy construction equipment; directly related accessory <br />materials and parts sales for such repair and servicing (not including new or used vehicle sales); and <br />accessory materials and parts warehousing which is related to and dependent upon such uses shall be <br />permitted, provided that: <br />a. All servicing of vehicles and equipment shall occur entirely within the principal structure. <br />b. To the extent required by state law and regulations, painting shall be conducted in an approved <br />paint booth, which thoroughly controls the emission of fumes, dust, or other particulate matter. <br />c. Storage and use of all flammable materials, including liquid and rags, shall conform with <br />applicable provisions of the state fire code. <br />d. Parking, driveway, and circulation standards and requirements shall be subject to the review and <br />approval of the city and shall be based upon the specific needs of the operation and shall <br />accommodate large vehicle equipment and semi-trailer/tractor trucks. <br />e. The storage of damaged vehicles and vehicle parts and accessory equipment must be completely <br />inside a principal or accessory building. <br />f. The sale of products other than those specifically mentioned in this section shall be subject to a <br />separate conditional use permit. <br />(Prior Code, § 1195-500.1 & 1195-080.1, § 90-208 & 90-250; Ord. No. 2010-453, § 3, 12-6-2010) <br />Sec. 90-250. Open or outdoor services, sale and rental. <br />(a) It is unlawful for any person to operate, or allow to be operated, any outdoor retail sales, except in <br />conformance with this chapter. <br />(b) The outdoor use must not take parking spaces as required by section 90-252 for the specified use. <br />(c) The sales area must be hard-surfaced to control dust. <br />(d) Seasonal sales are allowed subject to the following conditions: <br />(1) All seasonal open and outdoor services, sale and rental must apply for a special event permit following <br />the guidelines in section 90-39. <br />(2) Seasonal outdoor retail sales shall be allowed for a period of time not to exceed a combined total of <br />120 days in any 12-month period. Outdoor retail sales shall not occupy an area exceeding ten percent <br />of a lot's area, and shall meet all yard setback requirements. <br />(3) Where seasonal outdoor retail sales are conducted in a parking lot, they shall be confined to a defined <br />area, and not be allowed to obstruct access of emergency vehicles, shall maintain good traffic <br />circulation, and continue to provide adequate parking for the primary use in accordance with section <br />90-252. Temporary fencing or other suitable mechanisms shall be used to delineate the sales area and <br />provide for pedestrian safety.
