Sexually oriented businesses. <br />(a) It is unlawful for any person to produce, sell, stock, or provide sexually oriented materials or services, except <br />in conformance with this chapter. <br />(b) In no instance will a sexually oriented business be considered a home occupation. <br />(c) Performance standards: <br />(1) No sexually oriented use may be located within 300 feet of any church, synagogue, or other place set <br />aside for communal worship or prayer. <br />(2) No sexually oriented use may be located within 300 feet of any elementary, grammar, or secondary <br />school, or any childcare center. <br />(3) No sexually oriented use may be located within 300 feet of any public library. <br />(4) No sexually oriented principal use may be located within 300 feet of another sexually oriented principal <br />use. <br />(5) No sexually oriented use may be located within 300 feet of any public park. <br />(6) Sexually explicit material may not be displayed or stored in such a manner that it may be seen at any <br />time from any public sidewalk, roadway, or easement, or from any property not under the immediate <br />control of the business operator or owner. <br />(7) No vulgar or obscene language, picture, or character may be used on any sign or advertisement for a <br />sexually oriented use. <br />(8) No sexually oriented use may be conducted in conjunction with the sale or consumption of alcohol. <br />(9) A sign shall be displayed at all entrances to stores or areas where sexually oriented materials are <br />available for sale or view, and within two feet of door openings, stating, "This business sells or displays <br />material containing sexually oriented themes. Persons under 18 years of age shall not enter." <br />(Prior Code, § 1195-640.1, § 90-263) <br />State law reference(s)—Sexually oriented businesses, Minn. Stat. § 617.242. <br />Sec. 90-259. Short-term rentals. <br />(a) It shall be unlawful for any person or entity to offer for rent, or enter into a rental agreement, a dwelling <br />unit, or any other portion of their property, as a short-term rental in any zoning district within the city. State- <br />licensed hotels, motels, and lodging establishments located in areas where expressly permitted by the city's <br />land use regulations are allowed, subject to all applicable law and rules. <br />(Prior Code, § 90-264; Ord. No. 2021-508, § 1, 9-20-2021) <br />Sec. 90-260. Signs. <br />(a) Purpose/intent. It is unlawful for any person to construct, erect, install, or maintain any sign in the city, <br />except in conformance with this section. The intent of this ordinance is to create the framework for a <br />comprehensive and balanced system of sign regulations to facilitate easy and pleasant communication <br />between people and their environment and to avoid the visual clutter that is potentially harmful to traffic <br />and pedestrian safety, property values, business opportunities and community appearance. With these <br />purposes in mind, it is the intent of this ordinance to authorize signs which are:
