Residential facilities. <br />(a) It is unlawful for any person to construct or operate a residential facility, except in accordance with this <br />chapter. <br />(b) A residential facility must adhere to the following requirements: <br />(1) Residential facilities must be licensed by the state and/or county, where required. <br />(2) Residential facilities located in a single-family housing district must have an appearance similar in size, <br />scale, color, roofline, and materials as other homes in the zoning district. <br />(3) No residential facility shall provide accommodations to any person whose tenancy constitutes a direct <br />threat to the health and safety of other individuals. No residential facility shall accept court-ordered <br />referrals for treatment instead of incarceration without adequate physical security measures in place <br />and approved by the county sheriff. <br />(4) Adequate off-street parking shall be provided in accordance with section 90-252. <br />(5) Adequate utilities, including sewage disposal, must be available. <br />(6) Residential facilities must be in compliance with the standards found in Minn. Stat. §462, as may be <br />amended, for location and proximity to other residential facilities. <br />(7) Residential facilities shall be landscaped to the same standards as other uses in the zoning district <br />where it is located in accordance with section 90-236. <br />(Prior Code, § 1195-180.1, § 90-218 (Community residence)) <br />Sec. 90-257. Self-service storage facilities. <br />(a) It is unlawful for any person to construct, operate, or maintain a self-service storage facility, except in <br />conformance with this chapter. <br />(b) Self-service storage facilities shall be on parcels of land two acres or more in size. <br />(c) Units are to be used for dead storage only. Units are not to be used for retailing, auto repair, human <br />habitation, or any commercial activity, except as permitted by section 90-250. <br />(d) Combining office and/or retail space with a self-service storage facility may be allowed by conditional use <br />permit. <br />(e) Storage of hazardous or flammable materials is prohibited. <br />(f) No exterior storage is allowed. <br />(g) The facility shall be secured by either the walls of the structure and/or fencing. All doors on the units shall <br />face inward and away from the street and property lines. <br />(h) Only one entrance and exit to the facility is allowed for general public use. One additional emergency exit is <br />allowed for each two acres of property. <br />(i) An on-site manager is allowed only where adequate sanitary facilities are provided through connection to <br />the public sanitary sewer system. Use of portable sanitary facilities does not fulfill this requirement. <br />(Prior Code, § 1195-630.1, § 90-262)
