Registered land surveys and conveyance by metes and bounds. <br />All property conveyances must be made by plat, except for lots or parcels exceeding five acres in size that <br />may be made by metes and bounds description. Registered land surveys, where permitted by law, must be <br />approved in accordance with the platting process established in this article. <br />(Prior Code, § 1215-120.1) <br />Sec. 90-334. Assessment splits. <br />In the event a tract of land against which an assessment has been levied is thereafter subdivided, the city <br />council may, on application of the property owner or by its own motion, equitably apportion among the various <br />lots or parcels in the tract all of the installments of the assessments against the tract remaining unpaid and not <br />then due. <br />(Prior Code, § 1215-130.1) <br />Sec. 90-335. Utilities. <br />Wherever municipal sanitary sewer, storm sewer, or water service are reasonably available to a <br />development site, and the land is located in an area where such service is legally accessible, all land development <br />shall utilize such services. Where a property's zoning allows for a development density based on the availability of <br />municipal sewer and water service, and such municipal utilities are not reasonably available to the site, the <br />property shall not be subdivided or developed at a density greater than allowed for rural land divisions. <br />(Prior Code, § 1215-140.1) <br />Sec. 90-336. Standard conditions for land divisions. <br />(a) All parcels or lots of land created through any subdivision, platting or planned unit development process shall <br />be in conformance with the conditions contained in this section. <br />(1) Within the agricultural, long-term agricultural, and rural residential zoning districts, all parcels created <br />shall meet the criteria for rural land divisions found in the following table: <br /> Rural Land Division Standards <br />Requirement Possible Exceptions <br />(1) All lots shall meet the minimum lot standards for the zoning <br />district in which it is located, as described in article IV of this chapter. <br />(1)a. Variance is granted <br />in accordance with 90-40. <br />(1)b. Land is divided as a planned unit <br />development in accordance with this <br />article. <br />(2) All lots shall meet the minimum lot standards for any and all <br />overlay districts in which located, as described in article IV, division 2 <br />of this chapter as well as the density requirements found in section <br />90-137 of the shoreland overlay, if applicable. <br />(2) Variance is granted <br />in accordance with <br />section 90-40. <br />(3) All lots shall have a minimum contiguous <br />buildable area of 8,400 square feet, with a <br />front-to-side ratio not exceeding 3:1. <br />(3)a. Variance is granted <br />in accordance with 90-40. <br />(3)b. A permanent conservation <br />easement is provided across the entire
