The covenants should be drafted to prohibit the storage of anything <br /> in the garage or driveway that would prevent the storage and parking of vehicles. <br /> c. The developer/HOA shall be responsible for the maintenance of: <br /> i. The sidewalks, pathways, and private streets, <br /> ii. private utilities, <br /> iii. stormwater reuse irrigation system, <br /> iv. common spaces and landscaping, <br /> V. internal drainage areas in common space, <br /> vi. development signage, <br /> vii. and any proposed fencing or retaining walls. <br /> This shall be included in the homeowners association documents. <br /> d. Cross access agreements shall be provided for the private streets and driveways. <br /> These easements shall be provided for City review and approval and filed with the <br /> final plat. <br /> e. The developer shall satisfy the park dedication requirement for the project <br /> through a combination of land and fee contribution. The land dedication shall be <br /> 0.5 acres, satisfying 57% of the required amount, and the remaining dedication <br /> shall be paid in fee totaling $73,100. The developer shall be responsible for <br /> grading, installation of irrigation, sodding, landscaping, and hardscapes within the <br /> park area. <br /> f. A development agreement will need to be signed and executed in a form <br /> satisfactory to the City. <br /> g. The City's development fees will apply to this project. The fee amounts will be <br /> calculated and included as part of the Development Agreement. <br /> 14. Prior to issuance of building permits, the applicant must comply with the following <br /> conditions: <br /> a. All development fees shall be paid. <br /> b. Final plat and development agreement shall be recorded at Washington County. <br /> c. The development shall meet all of the conditions in the development agreement <br /> regarding issuance of building permits. <br /> ADOPTED by the City Council this 6t'day of July, 2026. <br />
