ORDINANCE 2008-428 <br />AN ORDINANCE AMENDING CHAPTER 90, ARTICLE IV, SECTION 90-265 SIGNS <br />THE CITY OF HUGO ORDAINS: <br />Section 1. The City Council of the City of Hugo does hereby amend Chapter 90, Article IV, Section 90- <br />1, amend the following: <br />SIGNS: It is unlawful for any person to construct, erect, install, or maintain any sign in the City of <br />Hugo, except in conformance with this ordinance. <br />Sec. 90-265 SIGNS. <br />It is unlawful for any person to construct, erect, install, or maintain any sign in the City of Hugo, <br />except in conformance with this ordinance. <br />(a) Purpose/Intent. The intent of this ordinance is to create the framework for a comprehensive <br />and balanced system of sign regulations to facilitate an easy and pleasant communication <br />between people and their environment and to avoid the visual clutter that is potentially harmful <br />to traffic and pedestrian safety, property values, business opportunities and community <br />appearance. With these purposes in mind, it is the intent of this ordinance to authorize signs <br />which are (1) compatible with their surroundings, (2) appropriate to the activity that displays <br />them, (3) expressive of the identity of the individual activities and the community as a whole, (4) <br />legible in the circumstances in which they are seen and, (5) encourage quality design and <br />construction. <br />It is not the purpose or intent of this sign ordinance to regulate the message displayed on any <br />sign; nor is it the purpose or intent of this article to regulate any building design or any display <br />not defined as a sign, or any sign which cannot be viewed from outside a building. <br />(b) General Standards. <br />a) Sign area will be calculated as the area of a single rectangle containing the entire <br />sign message and does not include the sign supports and brackets. <br />b) All signs shall be of sound structural quality, be maintained in good repair and have <br />a clean and neat appearance. Land adjacent to such sign shall be free from debris, <br />weeds and trash. If signs are not being maintained as described and the Community <br />Development Director deems them a public hazard or nuisance, such sign shall be <br />ordered to be repaired or removed. <br />c) The owner of any sign which is otherwise allowed by this sign ordinance may <br />substitute non-commercial copy in lieu of any other commercial or non-commercial <br />copy. This substitution of copy may be made without any additional approval or <br />permitting. The purpose of this provision is to prevent any inadvertent favoring of <br />commercial speech over non-commercial speech, or favoring of any particular non- <br />commercial message over any other non-commercial message. This provision <br />prevails over any more specific provision to the contrary. <br />
