above the regulatory flood protection elevation and proper elevated road access to the site <br />exists in accordance with Section 90-138 (5) of this chapter . No fill placed in the <br />floodway to meet the requirements of this Section shall increase flood stages of the 100 - <br />year or regional flood. <br />(2) Any new or replacement motor home not meeting the criteria of (1) above may, as an <br />alternative, be allowed as a conditional use if in accordance with the following provisions <br />and the provisions of Section 90-37 of this chapter. The applicant must submit an <br />emergency plan for the safe evacuation of all vehicles and people during the 100 year <br />flood. Said plan shall be prepared by a registered engineer or other qualified individual, <br />shall demonstrate that adequate time and personnel exist to carry out the evacuation, and <br />shall demonstrate the provisions of Section 90-138, (4) (K) (1) (i) and (ii) of this chapter <br />will be met. All attendant sewage and water facilities for new or replacement recreational <br />vehicles must be protected or constructed so as to not be impaired or contaminated during <br />times of flooding in accordance with Washington County's sewer and water regulations. <br />(3) All new or replacement motor homes in the Floodway or Flood Fringe Districts shall <br />not have any structural additions or decks whether or not its attached or detached from <br />the motor home. <br />Section 90-227 Fences <br />(a) It is unlawful for any person to construct or maintain a fence, except in conformance with <br />this chapter. <br />(b) Fences are allowed as an accessory use in all zoning districts of the city. No fence shall be <br />constructed in the urban development area or on a parcel of land ten acres or less in size in the <br />rural residential zoning district without a permit issued by the city building official. <br />(c) All fences shall be located entirely upon the property of the person owning the fence, except <br />line fences used for agricultural purposes. <br />(d) All fence owners shall maintain the fence in a state of good repair and appearance, and not <br />allow the fence to become a safety hazard or nuisance. The city building official may order the <br />removal or repair of any fence that is unsafe, seriously dilapidated, blocking drainage, or in any <br />way poses a threat to public health, safety, and welfare. <br />(e) No fences shall be placed in a public road right-of-way, except temporary barriers <br />authorized by public safety personnel, the city engineer, or the city maintenance supervisor. <br />(f) No fence shall be placed in a public drainage, ponding, or utility easement without a <br />conditional use permit, except temporary barriers authorized by public safety personnel, the city <br />engineer, or the city maintenance supervisor. <br />28 <br />
