ORDINANCE NO. 2004-393 <br />AN ORDINANCE OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA, <br />AMENDING SECTION 1195-720.1 OF THE HUGO COMPREHENSIVE LAND USE <br />REGULATIONS ON WIND -POWERED GENERATORS <br />Section 1. The City Council of the City of Hugo does hereby amend Section 1195-720.1 <br />Wind -Powered Generators, of the Hugo Comprehensive Land Use Regulations by adding the <br />following: <br />1195-720.1 WIND -POWERED GENERATORS <br />Subd. 4 <br />(J) All wind -powered generators shall be constructed as monopoles. <br />(K) All wind -powered generators shall be kept in a condition of good repair at <br />all times. <br />(L) If at any time the equipment produces an unusual amount of noise or <br />vibration not commonly associated with the normal operation of the equipment, <br />the generator shall be turned off until such time as repairs are made. <br />(G) At the time of approval of a wind -powered generator, the City may require <br />the owner to submit a right -of -entry agreement, allowing the City the right to enter <br />the property in order to turn off any malfunctioning equipment via the manual <br />shut-off device that is required to be installed by subsection (B). <br />Section 2. Severability. In the event that a court of competent jurisdiction adjudges any <br />part of this Ordinance to be invalid, such judgment shall not affect any other provision of this <br />Ordinance no specifically included within that judgment. <br />Section 3. Effective Date.
