<br />AN ORDINANCE OF THE CITY OF
<br />HUGO, WASHINGTON COUNTY, MIN-
<br />NESOTA, AMENDING CITY CODE
<br />CHAPTER 314 GOVERNING REPAIRS
<br />TO SEWER AND WATER SYSTEMS
<br />WITHIN THE CITY OF HUGO
<br />THE CITY COUNCIL OF THE CITY
<br />OF HUGO, WASHINGTON COUNTY,
<br />MINNESOTA, DOES HEREBY ORDAIN
<br />AS FOLLOWS:
<br />WHEREAS, the City of Hugo does not
<br />presently have an Ordinance which clari-
<br />fies the respective liability of the City and
<br />private parties for repair to sanitary
<br />sewer, storm sewer or water lines; and,
<br />WHEREAS, the City believes that
<br />such a provision is necessary to provide
<br />guidance in situations where repairs are
<br />needed to sanitary sewer, storm sewer or
<br />water lines; and,
<br />NOW, THEREFORE, it is hereby
<br />ordained as follows:
<br />Section 1. Amendment.
<br />The City Code of the City of Hugo,
<br />'Washington County, Minnesota is hereby
<br />amended to add the following as Section
<br />314-24:
<br />"Liability for Repairs. After the initial
<br />connection has been made to the curb
<br />stop or the sewer lead the applicant,
<br />owner, or the occupant or user of such
<br />premises shall be liable for all repairs
<br />required to any water line or sanitary
<br />sewer or storm sewer lines necessary for
<br />;tion of the premises to the street
<br />including any repairs necessary to
<br />curb stop box and any necessary
<br />street repairs; it shall be the responsibility
<br />of the applicant, owner, occupant or user
<br />to maintain the stop box at such height as
<br />will insure that it remains at the finished
<br />grade of the land or property.
<br />In the event a water main becomes
<br />frozen, the City of Hugo will be responsi-
<br />ble for thawing the same. The property
<br />owner shall have the sole responsibility of

<br />day of , 20 ; and printed below is a copy of the
<br />lower case alphabet from A to Z, both inclusive, which is hereby acknowledged
<br />as being the size and kind of type used in the composition and publication of
<br />the notice:
