ORDINANCE 1998-318 <br />AN ORDINANCE REPEALING THE EXISTING CHAPTER 263 IN <br />ITS ENTIRETY AND ADOPTING A REVISED INDIVIDUAL <br />SEWAGE TREATMENT SYSTEM ORDINANCE <br />CHAPTER 263 - INDIVIDUAL SEWAGE TREATMENT SYSTEM <br />263-1. PURPOSE AND INTENT <br />This Ordinance is adopted for the purpose of protecting the health, safety and welfare of the <br />residents of Hugo through regulating the location, design, installation, use, and maintenance of <br />individual sewage treatment systems so as to prevent contamination of surface and ground <br />waters. <br />263-2. REPEAL OF INCONSISTENT ORDINANCE <br />Chapter 263 - Individual Sewage Treatment Systems, as it existed at the time of adoption of this <br />ordinance, is hereby repealed in its entirety and replaced with this ordinance. <br />263-3. ADOPTION OF WASHINGTON COUNTY INDIVIDUAL SEWAGE TREATMENT <br />SYSTEM ORDINANCE <br />Chapter 4 of the Washington County Development Code entitled "Individual Sewage Treatment <br />System Regulations" as dated October 20, 1997, is hereby adopted by reference in its entirety as <br />if herein printed in full, except as specifically changed in paragraphs 263-4 and 263-5 below. <br />263-4. LOCAL MODIFICATIONS OF COUNTY ORDINANCE <br />Subd. A. Where reference is made to The Washington County Board of Commissioners, it shall <br />be changed to read, "The Hugo City Council". <br />Subd. B. Where reference is made to the Washington County Public Health Department, it shall <br />be changed to read, "The City of Hugo Code Enforcement Officer". <br />Subd. C. Where reference is made to the Washington County Board of Adjustment and <br />Appeals, it shall be changed to read, "The City of Hugo Board of Adjustment and Appeals". <br />Subd. D. Where reference is made to the Washington County Planning Advisory Commission, <br />it shall be changed to read, "The Hugo City Council or designated agent'. <br />Subd. E. The permitting authority under the Ordinance shall be the Hugo City Council. <br />263-5. REQUIRED INSPECTIONS <br />Subd. A. The owners of Individual Sewage Treatment Systems shall have their system serviced <br />at least once every three years. Such service shall include the removal of effluent from the <br />holding tanks and a visual inspection of system components to determine if they are functioning <br />adequately. The service must be performed by a person licensed to perform such work by the <br />Minnesota Pollution Control Agency. <br />Subd. B. A complete and accurate report of the inspection shall be provided to the City by the <br />person performing the work. Such report shall be provided on forms provided by the City. <br />
