RESOLUTION 2015-38 APPROVING PUD GENERAL PLAN FOR D.R.HORTON, ICN IMMESOTA FOR "CLEARWATER COVE" ON PROPERTY LOCATED SOUTH OF FRENCHMAN ROAD (CSAH 9) AND EAST OF EVERTON AVENUE NORTH WHEREAS, D.R. Horton, Inc — Minnesota has requested approval of a PUD general plan to allow 89 single family residential lots and 7 outlots on the 40.5 acre property legally described as follows: (See Attached) WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by D.R. Horton, Inc—Minnesota, subject to the following conditions: 1. A PUD general plan is approved to allow the creation of 89 single family residential lots and 7 outlets. The development shall be constructed in accordance with the plans and application received by the City on June 18, 2015, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested rezoning of the 40.5 acre property and preliminary plat. 3. The PUD general plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 4. The applicant shall comply with all conditions in the City Engineer's letter dated July 16, 2015. 5. PUD flexibility is granted to allow: a) Flexibility to allow a minimum lot size of 8,103 square feet, where 10,400 square feet is required. b) Flexibility to allow a minimum lot width of 65 feet, were 80 feet is required by ordinance. c) Flexibility to allow a minimum front setback of 25 feet, where 30 feet is required. d) Flexibility to allow a minimum side yard setback of 7.5 feet, where 15 feet is required. e) Flexibility to allow building coverage on each lot to be 35%, where 30% is required.
