RESOLUTION 2015-38 <br />APPROVING PUD GENERAL PLAN FOR D.R.HORTON, ICN IMMESOTA <br />FOR "CLEARWATER COVE" ON PROPERTY LOCATED SOUTH OF <br />FRENCHMAN ROAD (CSAH 9) AND EAST OF EVERTON AVENUE NORTH <br />WHEREAS, D.R. Horton, Inc — Minnesota has requested approval of a PUD general plan <br />to allow 89 single family residential lots and 7 outlots on the 40.5 acre property legally <br />described as follows: <br />(See Attached) <br />WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly <br />called Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by D.R. Horton, Inc—Minnesota, subject to the following conditions: <br />1. A PUD general plan is approved to allow the creation of 89 single family residential <br />lots and 7 outlets. The development shall be constructed in accordance with the plans <br />and application received by the City on June 18, 2015, except as amended by this <br />resolution. <br />2. Approval is contingent upon City Council approval of the requested rezoning of the <br />40.5 acre property and preliminary plat. <br />3. The PUD general plan is approved based on the finding that the proposed project is <br />consistent with the City's Comprehensive Plan. <br />4. The applicant shall comply with all conditions in the City Engineer's letter dated July <br />16, 2015. <br />5. PUD flexibility is granted to allow: <br />a) Flexibility to allow a minimum lot size of 8,103 square feet, where 10,400 <br />square feet is required. <br />b) Flexibility to allow a minimum lot width of 65 feet, were 80 feet is required <br />by ordinance. <br />c) Flexibility to allow a minimum front setback of 25 feet, where 30 feet is <br />required. <br />d) Flexibility to allow a minimum side yard setback of 7.5 feet, where 15 feet is <br />required. <br />e) Flexibility to allow building coverage on each lot to be 35%, where 30% is <br />required. <br />
