RESOLUTION 2015-39 APPROVING PRELIMINARY PLAT FOR CLEARWATER COVE ON PROPERTY LOCATED SOUTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF EVERTON AVENUE NORTH WHEREAS, D.R. Horton, Inc — Minnesota, has requested approval of a preliminary plat to allow construction of 89 single family lots and 7 outlots on the 56.6 acre property legally described as follows: (See Attached) WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by D.R. Horton, Ino-- Minnesota, for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 89 single family home lots and 7 outlots, in accordance with the plans and application received by the City on June 18, 2015, except as amended by this resolution. 2. Approval is contingent upon City Council approval of a rezoning to PUD for the 40.5 acre portion of the site. 1 The preliminary phasing plan is generally approved. a. Phase I shall include: i. A 110 foot wide roadway and utility easement shall be dedicated to the City for the portion of Oneka Parkway not within the plat for construction of the road. ii. The park equipment shall be fully installed per plans approved by the City. The 0.47 acres (Outlot F) shall be dedicated to the City. iii. The 8 foot wide bituminous public trail connection from Victor Gardens as shown in phase 1 shall be installed. b. Phase 2 shall include: The entire length of Oneka Parkway, from CSAR 8 to the development, shall be constructed as an urban section roadway to City standard, with sidewalk and trail, with the first layer of bituminous prior to issuance of a Certificate of Occupancy for the 1 st building.
