MINUTES FOR THE CITY COUNCIL MEETING OF MARCH 19 1990> <br />The meeting was called to order by Mayor Atkinson at 7:0PM. <br />PRESENT: McAllister, JesinsF::i, Olson„ 'Jail, Atkinson <br />City Attorney, Charles Johnson <br />City Engineer, Howard KUUsisto <br />City Clerk:, Mary Ann Creager <br />ABSENT: City Administrator, k::en Huber <br />Vail made motion, Olson seconded, to approve the minutes for the regular <br />City Council meeting of March 5, 1990 as submitted. <br />All aye. Motion Carried. <br />Jesinsk:i made motion, Olson seconded, to approve the claims for March 19, <br />1990 in the amount of $73,035.47. <br />All aye. Motion Carried. <br />SENATOR GARY LAIDIG/REPRESENTATIVE DOUG SWENSON <br />Senator Laidig and Representative Swenson requested an opportunity to <br />address the City Council immediately following their Town Meeting which <br />was held in the Council chambers from 6:00 PM Until 7:00 PM. Mayor <br />Atkinson spoke on behalf of the Council thanking the City's <br />representatives for taking the time to listen to Hugo's concerns. <br />CHARITABLE GAMBLING <br />Atkinson made motion, Vail seconded, that the City of Hugo has no <br />obiection to the issuance of a gamling license to the American Legion Post <br />#62C► to operate pull tabs at 577.6 North 147th Street, Huqo, MN and waiver <br />of the 60 day waiting period. <br />All aye. Motion Carried. <br />LEGAL OPINIONS - ZALUCKYJ/SCHTOWCHAN SUBDIVISION <br />This matter was tabled from the Council meeting of March 5, 1990, and as <br />per Council direction, the City Attorney has researched the question of <br />whether or not the City can require a drainage easement and a formal <br />subdivision of property as it relates to the ZalucN::yj/Schtowchan <br />subdivision. Mr. ZalUc�--:yi's attorney has indicated that the City has no <br />jurisdiction in the matter; however, the City Attorney has researched this <br />matter and has indicated the following: <br />1. Under the circLAmstances, there appears to be no change of land use <br />that will allow for the taking of a drainage easement at this time. <br />In reviewing Minnesota Statute, it would appear that the City does <br />have subdivision jurisdiction and can require the subdivision of the <br />property based on the land division/consolidation currently being <br />proposed. <br />
