The meeting was called to order by Mayor Atkinson at 7:00 PM. <br />PRESENT: McAllister, Jesinski, Olson, Vail, Atkinson <br />City Administrator, Keh Huber <br />City Engineer, Howard Kuusisto <br />City Clerk, Mary Ann Creager <br />Vail made motion, Olson seconded, to approve the minutes for the regular <br />City Council meeting of September 17, 1990 as amended. <br />All aye. Motion Carried. <br />Jesinski made motion, Olson seconded, to approve the claims for October 1, <br />1990 in the amount of $131,014.84. <br />All aye. Motion Carried. <br />Mr. Cary Strantz has made application to the City of Hugo for a variance <br />to allow for the construction of a swimming pool and deck within 9' of the <br />property line on his property at 5920 138th St., Hugo, Minnesota (Lot 1, <br />Block 1, Hugo Meadows Subd.). City ordinances require a 30' setback for <br />all structures on corner lots, and this request would allow encroachment <br />21' into that setback. Originally, Mr. Strantz proposed to construct the <br />swimming pool in the back yard; however, he was prohibited from doing so <br />because of the drainage easement located on site. The City staff could <br />not tell if the deck and swimming pool will create any visual obstructions <br />for motor vehicles traveling on 138th St. or Foxhill Ave.; however, <br />without a deck elevation, it is difficult to make a positive assessment of <br />visibility concerns. At their meeting of September 26, 1990, the Hugo <br />Board of Zoning Adjustments reviewed this matter and recommended approval <br />of the variance request, as requested. <br />McAllister made motion, Olson seconded, to approve the variance request of <br />Mr. Cary Strantz of 5920 138th Street North (aka Lot 1, Block 1, Hugo <br />Meadows subd.,) for the construction of a swimming pool and deck within 9' <br />of the west property line. The fence shall be located on private <br />property. <br />All aye. Motion Carried. <br />Stanley and Claudia Waters have made application to the City of Hugo for a <br />variance to construct a 20' X 30' wood -frame, detached garage on their <br />property at 12806 Ingersoll Ave. No., Hugo, Minnesota (aka Lot 13, except <br />the north 20' and Lots 14, 15, 16 of Block 2, Sunset Park, Hugo, <br />Minnesota). Their request would allow the garage to be constructed 20' <br />from Ingersoll Ave. (40' is required) and 50' from the high water mark of <br />Sunset Lake (100' is required)' The DNR has indicated they have no <br />objections to this variance as the site is elevated some 16' above the <br />high water mark of the lake. Because of the irregular shape of the lots <br />as they follow the contour of the lake, and the alignment of Ingersoll <br />
