61i <br />City Council meeting of 2/16/88 <br />zoned SFE, while the north portion is Conservancy. The line separating <br />the two districts goes through the residence located on site. If this <br />request is granted, the entire tract of land in question would be zoned <br />SFE allowing for one acre parcels. Mr. Potter has indicated he is <br />contemplating the subdivision of the proerty in question should it be <br />rezoned. The property is located within 1,000' of lakeshore, and we have <br />notified the DNR who indicated they have no comments regarding this <br />proposal. This matter was reviewed by the Planning Commission at their <br />January 27, 1988 meeting, and said request was denied based on the <br />following: <br />1. They didn't feel that a single family estate district is appropriate <br />for the area, and that the site was more conducive to a Conservancy <br />zone. <br />2. Utilities were not available to this site to accommodate one acre <br />lots. <br />3. The area in question is very swampy and would be very difficult to <br />develop. <br />Mr. Potter has submitted a tentative subdivision proposal that would allow <br />for one 3 acre lot and two 4 acre lots on the site in question. The <br />Planning Commission indicated its concern that once the property was zoned <br />SFE, there is nothing to hold Mr. Potter to his commitment that he will <br />subdivide the property in tracts of land as large as currently proposed. <br />Mr. Potter was notified that rezoning of the land does not guarantee <br />approval of his proposed subdivision nor does it guarantee that the sites <br />are buildable unless they pass percolation tests and meet other code <br />requirements. <br />Mayor Atkinson stated that he personally was in favor of the rezoning <br />request as the best use of the land, but felt that land should remain in <br />larger than one acre lots because of the wetlands. Because Mr. Potter has <br />made it clear that he intends to subdivide the property should he obtain <br />rezoning approval, Mayor Atkinson stated that any subdivision would <br />require that any deeds would have a restrictive convenant stating that <br />that particular parcel could not be further subdivided. Councilman Potts <br />felt that if three acres was the smallest lot size the city would like to <br />see it that area, that the property should be rezoned to RRI thereby <br />eliminating any further subdivision of newly created parcels. <br />Atkinson made motion, Vail seconded, to adopt ORDINANCE 1988-247, AN <br />ORDINANCE REZONING THE DESCRIBED REAL PROPERTY FROM CONSERVANCY TO SFE. <br />VOTING AYE: Olson, Atkinson <br />VOTING NAY: Peltier, Potts, Vail <br />Motion Failed. <br />Potts made motion, Peltier seconded, to support a rezoning to RRI as <br />opposed to SFE subject to meeting legal requirements. <br />VOTING AYE: Peltier, Potts, Olson, Vail, Atkinson <br />VOTING NAY: None <br />Motion Carried. <br />
