/30 <br />City Council meeting of October 17, 1988 <br />Page 2 <br />City Attorney, Charles Johnson, noted his concerns with the proposed <br />agreement, and his recommendations should be incorporated into a new draft <br />copy. <br />Olson made motion, Peltier seconded, that any action on the proposed ,joint <br />Powers Agreement be tabled until the city attorney's recommendations are <br />incorporated into a new draft copy. <br />All aye. Motion Carried. <br />ANDERSON HILLS FINAL PLAT <br />Mr. Byron Anderson has made application to the city for subdivision of a <br />54 acre tract of land into five 10 acre building sites. The property in <br />question is zoned agriculture, and is located north of 152nd Street. The <br />site is located in the N 1/2 of the SE 1/4 of Section 14, T31N, R21W, <br />Washington County, Minnesota. The applicant intends to serve the site in <br />question with utilities by the use of on-site septic systems and private <br />water wells. A surface water drainage plan for this development has been <br />approved by Rice Creek Watershed District, and we have received the <br />approved permits from the district. The applicant is requesting a <br />variance allowing for tracts of 9.99 acres in size, and authorization to <br />construct a single family dwelling within 100' of the water's edge on Lot <br />3 of this development. The preliminary plat of this subdivision was <br />approved by the Planning Commission and City Council on earlier dates <br />subject to special conditions. A development agreement is not required <br />for this plat as no public improvements are involved. <br />Olson made motion, Vail seconded, to approve the final plat of ANDERSON <br />HILLS, and two variances, one to allow for tracts of 9.99 acres in size, <br />and the other for authorization to construct a single family dwelling <br />within 100' of the water's edge of Lot •3 of this development. The <br />applicant shall also record the restrictive covenants at Washington County <br />prior to the city signing the final plat. The property•is located in the <br />N 1/2 of the Se 1/4 of Section 14, T31N, R21W, Washington County, <br />Minnesota. Approval of this subdivision is subject to the following <br />conditions: <br />1. All deeds and covenants used in the sale of lots identified in this <br />plat must identify those lots located in the floodplain Zone D. <br />2. All property lines on site are to be identified by the applicant to <br />assure proper building setbacks when buildings are to be constructed, <br />if required by the building inspector. <br />3. No commercial or industrial use of the property in question shall be <br />permitted. <br />4. Driveways and drainage areas must include the installation of a <br />minimum 15" diameter corrugated metal culvert in a manner acceptable <br />to the city. <br />S. No building permits shall be issued to lots identified on this plat <br />unless building locations and construction is in compliance with the <br />city's floodplain and shoreland regulations. <br />b.
