/ T( <br />City Council meeting of 12/19/88 <br />Page 2 <br />Captain Tom Greene of the Washington County Sheriff's Office was present <br />to explain the incident reports, and reviewed Ricci's past convictions of <br />liquor ordinance violations. Mr. Ricci was present and stated that he <br />felt he was being harassed by the sheriff's office. (ATTORNEY CHARLES <br />JOHNSON ARRIVED AT 6:45 PM.) Mr. Ricci also felt that the violations were <br />not serious (after-hours occupancy) because they did not involve liquor <br />consumption. Councilman Potts suggested a five day revocation, but <br />suspend the revocation if there were no other violations within a year. <br />Councilmember Peltier questioned why there were so many warnings issued <br />before a citation was issued. Councilman Olson felt that because of the <br />many warnings that were issued, it would be appropriate for the city to <br />order a three day suspension, waive two days if no there are more <br />violations, and serve a one day suspension. Mayor Atkinson and Olson felt <br />that the city had to enforce city ordinances because of the many warnings <br />issued to Mr' Ricci. Councilmen Potts and Olson did not feel that Mr. <br />Ricci was being harassed in that the deputies were only doing their jobs. <br />Atkinson made motion, Vail seconded, to adopt RESOLUTION 88-57, RESOLUTION <br />DIRECTING THE SUSPENSION OF LIQUOR LICENSES FOR ROBERT M. RICCI. <br />VOTING AYE: Olson, Vail, Atkinson <br />VOTING NAY: Peltier, Potts <br />Motion Carried. <br />WHITE BEAR TOWNSHIP - JOINT POWERS AGREEMENT <br />At the request of the City Council, White Bear Township has revised the <br />language in the Joint Powers Agreement for the 120th Street road <br />improvement project as per the recommendations of the city attorney' <br />Atkinson made motion, Vail seconded, authorizing the City of Hugo to enter <br />into a Joint Powers Agreement with White Bear Township and Ramsey County <br />for the improvement of County Road J (120th Street North). <br />VOTING AYE: Olson, Potts, Vail, Atkinson <br />VOTING NAY: Peltier <br />Motion Carried. <br />Mr. Stanford Krueger has requested Council consideration for allowing hin <br />to begin construction on his home by December of 1989 as opposed to the <br />previously designated December 31, 1988 date. Mr. Krueger received a <br />special use permit allowing him to construct an accessory building prior <br />to a principal residence, and said request was granted subject to special <br />conditions. Item #10 of the SUP requires that the principal building mus <br />be substantially underway by 12/31/88. Mr. Krueger has indicated that <br />because of the cost of site improvements, he will not be ahle to begin <br />constructicx' of the principal residence until some time in 1989. He is <br />requesting that the date in Item 410 of the SUP be extended to 12/31/89. <br />
