25 <br />MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL <br />March 2, 1987 <br />The regular meeting of the City Council was called to order by Mayor Atkinson at 7:00 PM. <br />PRESENT: Bob Olson, Peltier, Potts, Vail, Atkinson <br />City Administrator, Ken Huber <br />3.0 Approval of Minutes <br />Motion made by Peltier, Potts seconded, to approve the minutes of February 17, 1987 <br />as amended. <br />All aye. Motion Carried. <br />4.0 Approval of Claims <br />Motion made by Vail, Peltier seconded, to approve the General Claims for March 2, <br />1987 in the amount of $6,191.03. <br />All aye. Motion Carried. <br />Motion made by Peltier, Potts seconded, to approve the Utility Claims for March 2, <br />1987 in the amount of $42.36. <br />All aye. Motion Carried. <br />6.A Petition to Vacate Street (Zerwas and Schletty) <br />Pursuant to Minnesota Statute 412.851, Lyle Zerwas, Howard Schletty, and others have <br />petitioned the City of Hugo for the vacation of 60 feet of street right-of-way located <br />in part of the north one-half of the northeast one-quarter (N2 -of NE4) Section 28, <br />T31N, R21W, Washington County, Minnesota. This request is being made as a followup <br />to an earlier action dedicating a street easement to the City of Hugo by Mr. Howard <br />Schletty and Mr. Lyle Zerwas. Both the street rededication and the petition to <br />vacate are a result of street right-of-way being improperly shown on a certificate <br />of survey which was subsequently approved by the city. Mr. Schletty now indicates <br />that the roadway previously dedicated to the city reflects the current location <br />of the roadway as it exists, and there is no need to retain the right-of-way pre- <br />viously shown at the incorrect location. The property in question is 30 feet in <br />width and approximately 446 feet in length. There appears to be no utilities located <br />in this area, and we can see no objection to the vacation request in question. A <br />public hearing has been scheduledfor tonight's meeting at 7:00 PM to secure input <br />from anyone who may wish to voice their objections or support for this request. We <br />have notified the appropriate utility companies and no one has indicated any object- <br />ions to granting this vacation request. <br />Mayor Atkinson called the public hearing to order at 7:05 PM. There were no oral <br />or written objections to this vacation request, and the public hearing was closed <br />at 7:07 PM. <br />Motion made Vail, Olson seconded, to adopt RESOLUTION 1987-31, A RESOLUTION VACATING <br />A ROADWAY EASEMENT AS PER PETITION OF HOWARD SCHLETTY AND LYLE ZERWAS. <br />VOTING AYE: Olson, Potts, Vail, Atkinson <br />ABSTAINED: Peltier <br />Motion Carried. <br />
