RAi <br />April 21, 1986 <br />MOTION: McAllister made motion, Potts seconded, that Mrs. Peltier be in charge <br />of screening invoices before being placed on agenda for claims. <br />All aye. Motion Carried. <br />BALD EAGLE BRIDGE PROTECT <br />MOTION: McAllister made motion, Hauer seconded, that the engineer be given the <br />authorization to hire surveyors for the Bald Eagle bridge program. <br />All aye. Motion Carried. <br />Mr. Seever, Oneka Lake Blvd., had contacted Councilman Potts regarding flooding <br />as a result of the releasing of water from Oneka Lake. It was suggested, and <br />Mayor McAllister concurred, that the placing of benchmarks to indicate water levels <br />would be a good idea. <br />George and Kathy Schtowchan, 7041 Oneka Lake Boulevard, were present and expressed <br />concern with the possibility of flooding on their property when the ditch project, <br />releasing water from One-ka Lake, is implemented. Fred Hummel, 7225 Oneka Lake <br />Boulevard, was also present and requested the city to provide a written statement <br />regarding specifics relating to the project. He wa concerned that when the present <br />Council no longer exists, it is important that thepple are informed. Mr. Hummel <br />did not want the e -ate of water discharged to exceed the level of the existing <br />culvert. Mayor McAllister asked that Mr. Hummel write down his concerns and <br />submit to the City Engineer for his recommendation tothe city. <br />MOTION: McAllister made motion, Peltier seconded, to adopt RESOLUTION 1986-5, A <br />RESOLUTION AUTHORIZING THE CITY LEGAL STAFF TO INITIATE FORMAL CONDEMNATION <br />PROCEEDINGS TO OBTAIN PROPERTY OWNED BY ALEX AND/OR TAMARA ZALUCKYJ AS <br />ATTACHED AND DESCRIBED AS EXHIBIT "A" (CERTIFICATE OF SURVEY) AND <br />EXHIBIT "B" (LEGAL DESCRIPTION). AND BE IT FURTHER RESOLVED, THE <br />CITY LEGAL STAFF IS DIRECTED TO PETITION THE COURT FOR ACCESS TO THE <br />PROPERTY AS QUICKLY AS MAY BE ALLOWED BY LAW. <br />All aye. Motion Carried. <br />The following is an itinerary for this project: <br />1. The survey and legal description should be completed by end of the week of 4/21/86. <br />2. On April 28, there will be a staff meeting at Howard Kuusisto's office (legal <br />and engineering) to sign the documents for condemnation. <br />3. Before May 19, we are going to try and get the documents filed at Washington Cty. <br />4. Once we file the documents, the question is whether we have to wait 90 days <br />to file a court injunction - hopefully not. If we can file during the 90 day <br />period, the earliest we could get possession of the property is August 18. <br />5. After the sealed bids are opened on May 19, there is 105 days that we must <br />give a start workorder. That will take us to September 1st. <br />MISCELLANEOUS <br />MOTION: McAllister made motion, Scwhab seconded, that Councilmen Hauer and Schwab <br />draft a new ordinance containing provisions as to the dollar amount for <br />parkland dedication and report to the Council within 60 days. <br />All aye. Motion Carried. <br />
