3 <br />January 7, 1985 <br />AMENDED DEVELOPMENT AGREEMENT - Lake Air Estates <br />MOTION: McAllister made motion, Peltier seconded, that the Mayor and City Clerk be <br />authorized to execute the amended Development Agreement for Birchwood <br />Builders, Inc. <br />All aye. Motion Carried. <br />BOARD OF APPEALS <br />This board, which is now non-existent, will be comprised of the vice -chairperson of <br />the Planning Commission, member of the City Council, and a citizen at large. Council <br />representative from Wards 1, 2, and 3, are to suhniit a name from each ward, and one <br />of the names will be drawn. <br />5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES <br />5.1 PUBLIC HEARING <br />The public hearing was called to order at 8:37 PM to consider the inclusion of wood- <br />working shops in the AG and CONS district by Special Use Permit. William O'Mara, <br />16337 Harrow Avenue, was present and stated that there should be no commercial or <br />industrial operations in the residential or rural area. There were no other public <br />convents. The public hearing was closed at 8:40 PM, and the regular meeting called <br />back to order. Peltier had looked at the Hubman operation, for which this public <br />hearing was called, and did not feel his operation would be a problem. However, <br />another operation could create a nuisance. It was determined that if this proposal <br />passed, the city would need a definition of woodworking operations to protect the <br />applicant as well as any adjoining landowners. <br />MOTION: Peltier made motion, McAllister seconded, that the City Clerk be directed to <br />draft an ordinance to allow woodworking shops in the AG and CONS districts <br />by Special Use Permit only, and that a definition of woodworking shops be <br />included. <br />AYE: Peltier, Schwab, Hauer, McAllister <br />NAY: Potts <br />All aye. Motion Carried. <br />5.2 Frank Puleo - Rezoning <br />Mr. Puleo, and his partners, requested a rezoning of approximately 8.8 acres from SFE <br />to IND to accommodate the manufacturing of grab bars for the handicap in their accessory <br />building. The Planning Commission recommended denial of the application. Adjoining <br />landowners had no objection to the work being done, but did not want the property re- <br />zoned to Industrial to eliminate any possible future problems. Mr. Puleo stated that <br />he would do what had to be done to resolve the problem, but Mayor McAllister stated that <br />the Council has limitations as to what they can and cannot do. The city was not aware <br />of any manufacturing to be done in the garage when they appeared before the city <br />for a Special Use Permit for its construction. <br />MOTION: McAllister made motion, Hauer seconded, to <br />ORDINANCE AMENDING CHAPTER 320 OF THE HUGO <br />AMENDING THE DESCRIBED REAL PROPERTY. <br />AYE: Peltier, Schwab, Hauer <br />NAY: Potts, McAllister <br />MOTION FAILED FOR LACK OF 4/5's VOTE. <br />adopt ORDINANCE 1985-213, AN <br />CITY CODE ENTITLED ZONING BY <br />
