A Letter of Credit, in the amount of $1,000.00, shall be submitted to the City of Hugo to insure the following: a. Erosion control structure maintained. b. Limit fill to areas and depths indicated on plan. c. A 10' utility and drainage easement be obtained by the City along the property line between Lots 5 and 6. The Letter of Credit to terminate when the engineer has cer- tified the turf is restored. All aye. Motion Carried. 5.1 David Schumann - Complaint Mr. Schumann, 7630 137th Street, appeared before the Council to discuss the condition of his property. Mayor McAllister stated that after making a visual inspection of Schumann's property, it would appear that there is a violation of the Hugo City Code. Mr. Schumann is storAtk a large number of vehicles on his property without having a SUP to operateKh auto dismantling yard. Mr. Schumann stated that he would do whatever is necessary to correct the problem. Mayor McAllister stated that the city would table the verbal complaint received about Schumann's property, thereby giving Mr. Schumann the option to apply for a Special Use Permit for an auto reduction yard in the Agriculture District. MOTION: McAllister made motion, Potts seconded, that the City Clerk be directed to start a CONFIDENTIAL file, under Minnesota Privacy Data Act, where all information regarding complaints against people or property will be kept, and to order a rubber stamp CONFIDENTIAL. The only people with access to this file shall be the City Council members, the city attorney, and law enforcement personnel assigned to the City. All complaints shall be in writing. The City of Hugo does not accept telephone or verbal complaints effective this date. All aye. Motion Carried. The City was served with 17 interrogatories in the Potts vs. Hugo legal matter. Because Mr. Potts is a member of the Council, Mayor McAllister did not feel it was in the best interest of the City to have an open meeting. McAllister stated that he will be meeting privately and individually with CouncilmeaMers Charles Schwab and James Hauer before he returns the interrogatories to Hugo's attorney. In his opinion (McAllister), that this is the only way to handle with the best interest of the City. He also stated that he is aware that this could be construed as a possible violation of the open meeting law. CLERK Mr. Garry Boyer was to appear before the Planning Commission at a previous meeting to discuss his application for a Special Use Permit, however, he failed to appear. Mr. Boyer is to be sent a certified letter stating that he will be placed on another PC agenda, and that if he doesn't attend, the City will take further action.
