/,2.), <br />December 2, 1985 <br />James Mostek - SUP (cont) <br />3. The property owner to sign a hold harmless agreement with the <br />City of Hugo. <br />4. A Letter of Credit, in the amount of $1,000.00, shall be submitted <br />to the City of Hugo to insure the following: <br />a. Erosion control structure maintained. <br />b. Limit fill to areas and depths indicated on plan. <br />c. A 10' utility and drainage easement be obtained by the <br />City along the property line between Lots 5 and 6. The <br />Letter of Credit to terminate when the engineer has cer- <br />tified the turf is restored. <br />All aye. Motion Carried. <br />5.1 David Schumann - Complaint <br />Mr. Schumann, 7630 137th Street, appeared before the Council to discuss the <br />condition of his property. Mayor McAllister stated that after making a visual <br />inspection of Schumann's property, it would appear that there is a violation <br />of the Hugo City Code. Mr. Schumann is storAtk a large number of vehicles on <br />his property without having a SUP to operateKh auto dismantling yard. Mr. <br />Schumann stated that he would do whatever is necessary to correct the problem. <br />Mayor McAllister stated that the city would table the verbal complaint received <br />about Schumann's property, thereby giving Mr. Schumann the option to apply <br />for a Special Use Permit for an auto reduction yard in the Agriculture District. <br />MOTION: McAllister made motion, Potts seconded, that the City Clerk be directed <br />to start a CONFIDENTIAL file, under Minnesota Privacy Data Act, where <br />all information regarding complaints against people or property will <br />be kept, and to order a rubber stamp CONFIDENTIAL. The only people <br />with access to this file shall be the City Council members, the city <br />attorney, and law enforcement personnel assigned to the City. All <br />complaints shall be in writing. The City of Hugo does not accept <br />telephone or verbal complaints effective this date. <br />All aye. Motion Carried. <br />The City was served with 17 interrogatories in the Potts vs. Hugo legal matter. <br />Because Mr. Potts is a member of the Council, Mayor McAllister did not feel it <br />was in the best interest of the City to have an open meeting. McAllister stated <br />that he will be meeting privately and individually with CouncilmeaMers Charles <br />Schwab and James Hauer before he returns the interrogatories to Hugo's attorney. <br />In his opinion (McAllister), that this is the only way to handle with the best <br />interest of the City. He also stated that he is aware that this could be <br />construed as a possible violation of the open meeting law. <br />CLERK <br />Mr. Garry Boyer was to appear before the Planning Commission at a previous <br />meeting to discuss his application for a Special Use Permit, however, he failed <br />to appear. Mr. Boyer is to be sent a certified letter stating that he will be <br />placed on another PC agenda, and that if he doesn't attend, the City will take <br />further action. <br />
