October 15, 1984 120 <br /> 5.2 Tom Pogreba - Disc on NSP easement <br /> Mr. Pogreba, landowner close to the NSP powerlines in Section 1, was present to ask <br /> about the road that is to be constructed to the Joseph Stanek property. He was in- <br /> formed that because NSP had built their powerlines in the city right-of-way, they <br /> are assisting financially in the obtaining of easements and construction of a new <br /> road. Mr. Pogreba requested to go on record as being opposed to the new roadway. <br /> CURT LEIBEL <br /> Mr. Leibel had informed the city that he is in the masonry business and would be <br /> building a structure on his property for that business. The lot is zoned RB and <br /> will need to be rezoned to Industrial to accommodate his business. Mr. Leibel <br /> has received Rice Creek approval for the filling of his lot as required for his <br /> application for a SUP to fill in the floodplain. <br /> MOTION: McAllister made nation, Hauer seconded, to approve the application for a <br /> Special Use Permit for Curt Leibel to fill Lot 93017-2875 in accordance <br /> with the conditions in the permit issued to him by the Rice Creek Watershed <br /> District, and payment of a duplicate SUP fee ($45.00) for violation of <br /> the city ordinance by filling his lot prior to obtaining a permit. <br /> All aye. Motion Carried. <br /> LLOYD SATHRE - Amended SUP <br /> Mr. Sathre was previously granted a SUP for the raising on non-domestic animals in <br /> the RRII zone. He was present at the Council meeting requesting authorization to <br /> construct a stockpond at the northeast corner of his property. Robert Olson, ad- <br /> joining property owner, stated that if all the experts assure no pollution of <br /> Sunset Lake, and the animals remain a distance from his residence, he had no ob- <br /> jection. <br /> MOTION: Schwab made motion, Atkinson seconded, to amend the Special Use Permit <br /> for Lloyd Sathre, as originally issued 9/4/84, to install a livestock <br /> water pit per specifications of the U.S. Department of Agriculture Soil <br /> Conservation Service. <br /> VOTING FOR: Atkinson, Schwab, McAllister <br /> VOTING AGAINST: Peltier, Hauer <br /> Motion Carried. <br /> MOTION: Peltier made motion, Schwab seconded, to extend the meeting passed 11 :00 PM. <br /> All aye. Notion Carried. <br /> MISCELLANEOUS <br /> Mr. Potts presented the Council with a new Water Resource Management Plan for <br /> the Rice Creek Watershed District. The city will further/his_comments and respond <br /> to Rice Creek Board of Managers. <br /> MOTION: Peltier made motion, Atkinson seconded, to adjourn at 11:33 PM. <br /> All aye.
