October 15, 1984 120 5.2 Tom Pogreba - Disc on NSP easement Mr. Pogreba, landowner close to the NSP powerlines in Section 1, was present to ask about the road that is to be constructed to the Joseph Stanek property. He was in- formed that because NSP had built their powerlines in the city right-of-way, they are assisting financially in the obtaining of easements and construction of a new road. Mr. Pogreba requested to go on record as being opposed to the new roadway. CURT LEIBEL Mr. Leibel had informed the city that he is in the masonry business and would be building a structure on his property for that business. The lot is zoned RB and will need to be rezoned to Industrial to accommodate his business. Mr. Leibel has received Rice Creek approval for the filling of his lot as required for his application for a SUP to fill in the floodplain. MOTION: McAllister made nation, Hauer seconded, to approve the application for a Special Use Permit for Curt Leibel to fill Lot 93017-2875 in accordance with the conditions in the permit issued to him by the Rice Creek Watershed District, and payment of a duplicate SUP fee ($45.00) for violation of the city ordinance by filling his lot prior to obtaining a permit. All aye. Motion Carried. LLOYD SATHRE - Amended SUP Mr. Sathre was previously granted a SUP for the raising on non-domestic animals in the RRII zone. He was present at the Council meeting requesting authorization to construct a stockpond at the northeast corner of his property. Robert Olson, ad- joining property owner, stated that if all the experts assure no pollution of Sunset Lake, and the animals remain a distance from his residence, he had no ob- jection. MOTION: Schwab made motion, Atkinson seconded, to amend the Special Use Permit for Lloyd Sathre, as originally issued 9/4/84, to install a livestock water pit per specifications of the U.S. Department of Agriculture Soil Conservation Service. VOTING FOR: Atkinson, Schwab, McAllister VOTING AGAINST: Peltier, Hauer Motion Carried. MOTION: Peltier made motion, Schwab seconded, to extend the meeting passed 11 :00 PM. All aye. Notion Carried. MISCELLANEOUS Mr. Potts presented the Council with a new Water Resource Management Plan for the Rice Creek Watershed District. The city will further/his_comments and respond to Rice Creek Board of Managers. MOTION: Peltier made motion, Atkinson seconded, to adjourn at 11:33 PM. All aye. Notion Carried.
