PRESENT: Peltier, Atkinson, Schwab, Vail, McAllister Also, Engineer Kuusisto and Attorney Johnson 3.0 APPROVAL OF MINUTES MOTION: Peltier made motion, Schwab seconded, to approve the minutes of September 6, 1983, as submitted. All aye. Motion Carried. 4.0 APPROVAL OF CLAIMS MOTION: Peltier made motion, Atkinson seconded, to approve the General Claims for September 19, 1983, as submitted. All aye. Motion Carried. MOTION: Vail made motion, Peltier seconded, to approve the Utility Claims for September 19, 1983, as submitted. All aye. Motion Carried. 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Vern Peloquin (Joe Oman) - Rezoning Mr. Peloquin, fee owner of the property to be rezoned from CB to SFE, and Mr. John Oman were present for the discussion. The City received letters from Hubbard Broad- casting, Robert Bernier, and Miscellaneous Metals. KSTP had no objection to the re- zoning, and Mr. Bernier had no objection provided consideration was given to placing a double wide unit on the lot closest to his residence. Mr. Fred Riermann, owner of MMF, was present to address concerns with the expansion of the park. He is concerned with water runoff, and possible complaints from residents about the amount of noise generated by his business. The Planning Commission ra.1/4Ju11 ded approval of the re- zoning, but delayed action on the Amended Special Use Permit for expansion of the park. Mayor McAllister stated that the rezoning and ASUP do not go hand in hand. It was also his feeling that the developer of the park should bear the responsibility of noise abatement due to the proximity of MMF. The Council recommended that the Planning Commission should address the following when considering the application for an Amended SUP: 1 . Fire protection (report from Fire Chief) . 2. Drainage of the expanded area. 3. Possible noise problems. 4. Alternate to Highway 61 for access/egress. Let the record show that the fee owner, Vern Peloquin, wants the City Council to act on the rezoning application this evening, and is aware that the SUP is still under consideration by the City Council and may or may not be granted. The Fire Chief is to appear before the Planning Commission to report on fire pro- tection in the trailer park (fire hydrants: how many and how far apart) . Mr. Oman stated that placing a double wide trailer on the lot adjoining Robert Bernier's would not be a problem. The Council will also be considering parkland dedication. 78 September 19, 1983 After discussion of the drainage plan for the expansion, Engineer Kuusisto was requested to contact the Rice Creek Watershed District regarding the pond lo- cated on KSTP property. Roger Nelson, designer of the drainage plan for Oman, questioned the requirement of Mr.Oman being solely responsible for possible noise abatement. Mr. Oman alleged that if the. SUP was not approved, the City would be receiving complaints about noise in the industrial park. MOTION: Peltier made motion, Vail seconded, to adopt ORDINANCE 194, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTTT'LED "ZONING" BY AMEND- ING THE ZONING DISTRICT CLASSIFICATION OF DESCRIBED REAL PROPERTY. VOTING FOR: Peltier, Atkinson, Schwab, Vail, McAllister MOTION CARRIED. MOTION: McAllister made motion, Peltier seconded, that the City of Hugo formally request the Rice Creek Watershed District to rei. pect the property owned by Hubbard Broadcasting for compliance with the permit issued by them, and request they provide a written report to the City of Hugo prior to September 28, 1983. All aye. Motion Carried. RESIGNATION - JAMES R. WISNER On 9/13/83, the City received the resignation of Jim Wisner, effective 9/30/83. MOTION: Schwab made motion, Peltier seconded, that the City of Hugo hire Mr. Ronald L. Gray as a permanent part-time employee, at $5.00/hour, ef- fective 9/20/83. All aye. Motion Carried. 5.2 Robert Ricci - Rezoning Mr. Ricci is proposing the rezoning of property from CB to SFU to allow for multiple family dwellings. Mr. Ricci then asked the City Council to cancel his request for rezoning. The two parcels will remain in their respective zones - CB and SFU. He is now proposing the placement of a 6-plex on the SFU lot. The lot will accommodate the building and meet the necessary setback requirements, as well as the required number of parking slots for each unit. A Special Use Permit is still required in the SFU zone. There is a sewer stub for the SFU lot but none for the lot zoned CB. There was some question as to the actual pro- perty lines for the two parcels after review of the .as built for the sani sewer. Any sewer work would be paid for by the developer. MOTION: Peltier made motion, Vail seconded, allowing Mr. Robert Ricci to withdraw his application for rezoning. All aye. Motion Carried. Mr. Ricci presented a rough sketch of the new proposal, and will prepare a more suitable site plan when he appears before the Planning Commission on 9/28. Vail suggested that the PC address the following matters during review of the SUP: parking, drainage, setbacks, no access/egress to Lower 147th Street, and shrubs. Mayor McAllister stated that the City would be looking at a letter of credit to guaranty the conditbns of the SUP. 79 September 19, 1983 MOTION: Peltier made motion, Atkinson seconded, that the City Council gives concept approval to the new Robert Ricci plan, and matter to be forwarded to the Planning Commission. All aye. Motion Carried. 5.3 Donald Opse - Site Plan Approval Mr. Opse, 8295 122nd Street North, would like to construct a 26 x 40 pole building for his personal use. MOTION: Peltier made motion, Vail seconded, to approve the Site Plan for Donald Opse, 8295 122nd Street, for the construction of a 26 x 40 pole building for his personal use, and according to submitted site plan. All aye. Motion Carried. 5.4 Robert Kostelecky - Site Plan Approval Mr. Kostelecky, 10150 Kerry Court, would like to construct a 26 x 40 pole building for his personal use. MOTION: Vail made motion, Peltier seconded, to approve the Site Plan for Robert Kostelecky, 10150 Kerry Court, for the construction of a 26 x 40 pole building for his personal use, and according to submitted site plan. All aye. Motion Carried. 5.5 Dennis Strohkirch - Site Plan Approval Mr. Strohkirch, representing Plastics, Inc. , submitted a site plan for the construction of a 40 x 80 cold storage building. Their application will be considered by Rice Creek at their meeting of 9/28, and anticipate their approval that night. MOTION: Peltier made motion, Schwab seconded, to approve the site Plan for Terry Wagener, Plastics, Inc. , for the construction of x 40 x 80 cold storage building on Lot 4, Block 1, Husnik Industrial Park. All aye. Motion Carried. Let the record show that applicant will need a permit from the RCWD. 6.0 ORDINANCES AND RESOLUTIONS 6.1 Ordinance 195 (Hopkins Rezoning) MOTION: Peltier made motion, Schwab seconded, to adopt ORDINANCE 195, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING THE ZONING DISTRICT CLASSIFICAITON OF DESCRIBED REAL PROPERTY. VOTING FOR: Peltier, Atkinson, Schwab, Vail, McAllister Motion Carried. September 19, 1983 80 MOTION: Peltier made motion, Schwab seconded, to adopt RESOLUTION 1983-8, A RE- SOLUTION THAT THE CITY OF HUGO REQUESTS THE RETENTION OF PROPERTY KNOWN AS SHADYSIDE, BLOCK 7, LOTS 11 - 21 , FOR EASEMENT PURPOSES. All aye. Motion Carried. MOTION: Atkinson made motion, Peltier seconded, to adopt RESOLUTION 1983-9, A RESOLUTION CERTIFYING ANNUAL LEVY TO THE COUNTY AUDITOR. All aye. Motion Carried. MOTION: Peltier made motion, Vail seconded, to adopt RESOLUTION 1983-10, A RESOLUTION REDUCING BY $24,200.00 THE TAXES LEVIED FOR COLLECTION OF SANITARY SEWER BONDS. All aye. Notion Carried. MOTION: Schwab made nation, Peltier seconded, to adopt RESOLUTION 1983-11, A RESOLUTION THAT THE CITY CLERK CERTIFY TO THE AUDITOR OF WASHINGTON COUNTY SPECIAL ASSESSMENTS FOR COLLECTION OF DELINQUENT UTILITY BILLS. All aye. Motion Carried. MOTION: Vail made motion, Peltier seconded, to adopt RESOLUTION 1983-12, A RESOLUTION CERTIFYING SPECIAL ASSESSMENT FOR PROJECT 8102 IN THE BALD EAGLE INDUSTRIAL PARK. All aye. Motion Carried. MOTION: Vail made motion, Schwab seconded, to adopt RESOLUTION 1983-13, a RESOLUTION CERTIFYING SPECIAL ASSESSMENT FOR WATERMAIN LOOP ENCLOSURE ON COUNTY ROAD 8A. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, to adopt RESOLUTION 1983-14, A RESOLUTION CERTIFYING THE STORM SEWER ASSESSMENT TO COUNTY AUDITOR. All aye. Notion Carried. MOTION: McAllister made motion, Peltier seconded, to adopt RESOLUTION 1983-15, A RESOLUTION CERTIFYING THE SANITARY SEWER ASSESSMENT TO THE COUNTY AUDITOR. All aye. Motion Carried. 7.0 UNFINISHED BUSINESS Let the record show that during the City Council meeting of this day, correspondence was hand delivered to the Mayor and City Attorney by James LeRoy Brevig, and correspondence has been referred to City Attorney for his consideration. Mayor McAllister has met with Robert Lockyear, Washington County Planner, in an attempt to finalize the city's Comprehensive Plan. New maps will be submitted. 81 • September 19, 1983 9.0 ATTORNEY AND ENGINEER Mr. Johnson submitted his monthly report. Mr. Johnson has referred current NSP correspondence to the City Engineer for his review. Doug Kruse submitted the signed Settlement Agreement. Copies of material submitted to City Attorney for his review. MOTION: Vail made motion, Peltier seconded, that the Mayor and City Clerk be authorized to execute the Settlement Agreement between Mr. Doug Kruse and the City of Hugo, upon approval from the City Attorney. All aye. Motion Carried. Mr. Kuusisto had no written report. MISCELLANEOUS MOTION: Vail made motion, Peltier seconded, to install street lights on the north end of Flay Avenue, and give authorization to the Mayor and City Engineer to execute a Job Order with NSP. All aye. Motion Carried. MOTION: McAllister made motion, Peltier seconded, that the City Attorney be directed to research the status of the SUP for the White Bear Rod & Gun Club and to respond with a legal opinion directly to the attorney for the White Bear Rod and Gun Club, forthwith.
