October 17, 1983 92 5.3 Ronald Granger - On-Sale Liquor License Hearing (8:00 PM) The city scheduled a hearing for 8:00 PM to hear any comments regarding the applica- tion of Ronald Granger for an on-sale liquor license/Sunday for Paul's Pizza. There was no one present to make comment. The Sheriff's Department sent a sstisfactory recommendation regarding a criminal history. Mr. Granger is aware of the financial guarantees necessary for these licenses, and will be submitted if granted. MOTION: Schwab made motion, Peltier seconded, to grant the following licenses to Ronald Granger for the establishment known as PAUL'S PIZZA: ON SALE INTOXICATING LIQUOR AND ON SALE SUNDAY LIQUOR, in the amount of $425.01 . All aye. Motion Carried. 5.4 Joe Oman - Amended Special Use Permit Mr. Oman is proposing the expansion of the Twin Pine Trailer Park to include 28 new units. The Planning Commission recommended approval subject to seven con- ditions that are available in the file. Karla Wahl, attorney for Mr. Oman, was present and stated that it was their position that the city could not require Mr. Oman to install fire hydrants. They contend that the state regulations for mobile home parks would supersede any conditions required by the city. Fire Chief, Ron Istvanovich, submitted a report stating his recommendation that three fire hydrants be installed in the expansion. He also enclosed pertinent portions of the UNIFORM FIRE CODES. There was some discrepancy as to whether the portions submitted were adopted codes. Mayor McAllister stated that he would like to talk directly to the Fire Marshall prior to taking any action on this matter. Roger Nelson, engineer for the park, stated that the cost for three hydrants and a 6" main would be approximately $15,000 to $20,000. Should Mr. Oman hookup to the city's water service, easements would have to be provided for normal utility main- tenance. It was Mayor McAllister's recommendation that the city should know for sure whether the codes addressed by the Fire Chief have actually been adopted. Ms. Wahl was in- formed that the next regular Council meeting was 11/7. She stated that that would be too late and the project would have to be dropped. Rather than delay action on the ASUP, the city could approve the application contingent to the requirements of the State Board of Health standards being met. The plans have been submitted to the State and should be approved next week. She reminded the Council that they are considering only the expansion and not the established park. Mayor McAllister stated that it was his opinion that the city would allow Mr. Oman to hookup to the city water supply. However, his opinion will change if the city is not allowed the use of the water. If Mr. Oman would have to install a private fire system, the city would require engineering specifications. Ms. Wahl requested the Council to take action on the matter this night or possibly set a Special Meeting prior to 11/7. M)TION: McAllister made motion, Schwab seconded, that the matter be tabled until the Special Meeting on November 2, 1983, at 7:00 PM, to consider the application of John J. Oman for an Amended Special Use Permit. The City Attorney will provide the Council with information regarding the current Minnesota requirement for fire codes in manufactured have parks. All aye.
