96 November 7, 1983 <br /> Frank Arcand - cont. <br /> MOTION: Peltier made motion, Schwab seconded, to approve the Special Use Permit <br /> for Frank Arcand, 12878 Irish Avenue North, for the construction of a <br /> 32 x 60 pole barn for his personal storage only. <br /> All aye. Motion Carried. <br /> 5.4 Tom Caruth - Rezoning <br /> Mr. Caruth withdrew his application for rezoning. <br /> 5.6 John Malinka - Land Division <br /> Mr. Malinka, owner of approximately 100 acres of land lying along 140th Street, <br /> Section 24, is proposing the division of that property into two parcels - <br /> 77.9 on a Contract for Deed and 20 acres for a homesite. Mr. Frederick Frost, <br /> fee owner of the property, countersigned the application, and proof-of-ownership <br /> was submitted. A Certificate of Survey has also been provided. <br /> MOTION: Peltier made motion, Schwab seconded, to approve the Land Division for <br /> John Malinka to divide approximately 97 acres into two parcels - 77.9 <br /> acres and 20 acres, more or less. <br /> All aye. Motion Carried. <br /> 5.7 David Fakler - Rezoning <br /> David Fakler, fee owner of 1 .2 acres on the northeast corner of Highway 61 and <br /> 165th Street, is proposing the rezoning of that property from SFE to CB. He <br /> is contemplating the placement of a restored automobiles for retail sales. The <br /> Planning Commission held a public hearing, and it was their recomdaation to rezone <br /> the property. Ron Cressman, neighboring resident, was present to express his <br /> concerns about the rezoning relative to drainage, and whether the city would be <br /> able to control the use of the property. Mr. Fakler would have to obtain a Special <br /> Use Permit for auto sales at that location, assuming the property is rezoned. Tom <br /> Crever was present, and commented that it was his feeling that the lot was better <br /> suited for business rather than a residence. He also stated that the lot was <br /> very low and would require a drainage plan. <br /> MOTION: Schwab made motion, Peltier seconded, to adopt ORDINANCE 196, AN ORDINANCE <br /> AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING <br /> THE ZONING DISTRICT CLASSIFICATION OF DESCRIBED REAL PROPERTY. <br /> VOTING FOR: Pelteir, Schwab, Vail, McAllister <br /> Motion Carried. <br /> 5.8 Donald Rieck - Renew of Mobile Hone Permit <br /> MOTION: McAllister made motion, Peltier seconded, to renew the Mobile Home Permit <br /> for Donald Rieck, 12718 Irish Avenue, under Chapter 40, Article III, <br /> Subdivision B, for a period of 90 days. <br /> All aye. Motion Carried. <br />
